Application of Reservations to the CISG in International Commercial Arbitration
Abstract:
Tato diplomová práce se zabývá otázkou, zda jsou rozhodci povinni aplikovat výhrady smluvních států k CISG stejně jako obecné soudy. Práce je členěna do pěti kapitol. První tři se zabývají analýzou institutu výhrad k mezinárodním smlouvám, analýzou jednotlivých výhrad k CISG a nakonec mezinárodním rozhodčím řízením a právem rozhodným pro meritum sporu. Abstract:
This thesis deals with a question whether arbitrators have to use reservations of contracting state to the CISG in the same way as national courts. Thesis includes five chapters. First three of them deal with reservations to the international treaties, reservations to the CISG and finally international arbitration and law applicable to the merits of dispute.
