Interrogating a witness as a particularly vulnerable victim

Abstract:

Bakalářská práce se zabývá problematikou výslechu svědka v roli zvlášť zranitelné oběti, se zaměřením na výslech dětských svědků, což je téma velmi zajímavé nejen z hlediska teoretických poznatků z oboru práva, kriminalistiky a psychologie, ale také z hlediska praxe. Cílem práce je rozebrat, analyzovat a prozkoumat danou problematiku z pohledu zmíněných vědních oborů s důrazem na zvlášť citlivý a ohleduplný přístup a vedení výslechu vyslýchajícím. První část práce je věnována, po vymezení základních pojmů, platné právní úpravě výslechu svědka. V druhé části práce se zabývám danou problematikou především z pohledu kriminalistiky a psychologie, popisuji průběh přípravy výslechu svědka, také jeho stádia a taktické postupy s důrazem na navázání a formování psychologického kontaktu vyslýchajícího s vyslýchaným, popisuji význam speciální výslechové místnosti, včetně fotodokumentace jejího interiéru uvedené v příloze A na konci této práce.

Abstract:

This bacholor´s thesis deals with the issues of interrogation of a witness in the role of a particularly vulnerable victim, focused on the examination of child witnesses. The topic is interesting not only from the point of view of the theoretical knowledge of law, criminology and psychology but also in terms of practice. The aim of this work is to analyse and examine these issues with emphasis on a particularly sensitive and tactful approach to the conduct of interrogation. The first part of the work is devoted to the definition of basic terms and valid legislation of witness interrogation. The second part deals with the topic especially from the point of view of criminology and psychology and describes the preparation phase of witness interrogation, its stages and tactical procedures with emphasis on making and forming the psychological contact between a witness and an investigator. The thesis also stresses the importance of a special interrogation room, including photodocumentation of its interior, stated in the appendix A at the end of this work.
