Mass Media and its Role in Mechanism of Legal Regulation

Abstract:

Role masových médií v mechanismu právní regulace představuje významné a aktuální téma soudobé veřejné diskuse. Jak vypovídá samotný název, jedná se o problematiku s interdisciplinárním přesahem, která v sobě zahrnuje aspekty právní teorie, masových médií a sociologie. Výchozí koncepce se zakládá na faktické hypotéze připuštění dopadu moci sdělovacích prostředků v legální sféře. V první polovině práce je téma především teoreticky vymezeno a zasazeno do právního rámce. V dalších pasážích dochází k aplikaci na skutečné mediální kauzy a právně relevantní případy, na nichž jsou ukázány praktické prvky propojování a možného vlivu masmédií na právo. Empirickou část zajišťují také rozhovor s bývalým soudcem Evropského soudu pro lidská práva, informace od dalších soudců a další příklady z praxe z různých, zejména evropských zemí. Cílem práce je přiblížení tématu skrze jednotlivé možnosti a případy, jmenovitě zvážení vlivu etiky a chování médií na soudcovské rozhodování či možnosti vlivu morálních panik spojených s vysokou mediální pozorností na přijetí nové právní úpravy.

Abstract:

The role of the mass media in the mechanism of legal regulation represents significant and current theme of contemporary public discussion. As the main title refers, the topic has the interdisciplinary range which includes knowledge of legal theory, mass media and sociology. The initial conception of work is based on the factual hypothesis of admitting certain size of mass media impact in legal sphere. First half of the thesis theoretically defines leading issues and its connection with legal frame. In the next chapters, the information is applied at real media affairs and legally relevant cases which demonstrate practical elements of the connection and the influence of media on law. The empirical part is provided also thanks to the interview with the former judge of the European Court of Human Rights, information from the other judges and the other practical case studies from variety of countries, mostly European ones. The major aim of the thesis is the approaching the topic through different possibilities and cases, namely the influence of media behaviour and ethics on judicial decision making process or the possible impact of moral panics, connected to high media attention, on formation of new legislation.
