The issue of artificial termination of pregnancy in court jurisprudence

Abstract:

Práce se zabývá problematikou umělého přerušení těhotenství, a to nejen z hlediska legislativy, ale především z pohledu soudní judikatury. Obě tato hlediska vytváří ucelený pohled na dané téma vybraných demokratických států a mezinárodních institucí. Problematika interrupcí je velmi citlivé téma, na které neexistuje celospolečenská shoda a je neustálým předmětem diskuzí. Jedná o jakýsi střet lidských práv mezi nenarozeným lidským plodem a osobou jeho matky, těhotné ženy. Mezi tato práva patří zejména o právo na život, právo na lidskou důstojnost, právo na respektování soukromého a rodinného života, tzv. reprodukční práva nebo například samotné právo na umělé přerušení těhotenství. V práci jsou tyto jednotlivá lidská práva detailně rozebírána. Práce primárně vychází z jejich legálního zakotvení v českém právním řádu, následně je zasazuje i do kontextu mezinárodních smluv, kterými je Česká republika vázána.Dále se práce zabývá pohledem Evropského soudu pro lidská práva na problematiku umělého přerušení těhotenství. Ve své rozhodovací praxi se Evropský soud pro lidská práva tímto tématem zabýval již několikrát, a proto práce detailně popisuje nejvýznamnější judikáty. Následně také analyzuje situaci ohledně interrupcí v jednotlivých evropských státech. Události minulého roku zapříčinily, že práce obsahuje také stále se vyvíjející situaci ohledně problematiky umělého přerušení těhotenství v USA. V práci je proto obsažena kapitola věnující se Nejvyššímu soudu USA a jeho pohledu na problematiku umělého přerušení těhotenství. Nejvyšší soud USA, jakožto nejvyšší instance federálního soudnictví ve Spojených státech, vydává závazné precedenty, které mají právní následky na celém území USA. Ohledně interrupcí vydal tři nejdůležitější precedenty, kterými jsou Roe v. Wade, Casey v. Planned Parenthood a nejnovější Dobbs v. Jackson Women's Health Organization, který zapříčinil zrušení federálního práva na interrupci a v jehož důsledku rozhodují o otázce interrupcí opět jednotlivé státy USA samy. Poslední kapitola práce proto sleduje nynější postoj těchto států k problematice umělého přerušení těhotenství.

Abstract:

The thesis deals with the issue of artificial termination of pregnancy, not only from the point of view of legislation, but especially from the point of view of judicial case law. Both of these perspectives create a comprehensive view of the topic of selected democratic states and international institutions. The issue of abortion is a very sensitive topic on which there is no society-wide consensus and is a constant subject of debate. It is a kind of conflict of human rights between the unborn human foetus and the person of its mother, the pregnant woman. These rights include, in particular, the right to life, the right to human dignity, the right to respect for private and family life, so-called reproductive rights or, for example, the right to an artificial termination of pregnancy itself. In this thesis, these individual human rights are discussed in detail. The work is primarily based on their legal anchoring in the Czech legal system, and then it places them in the context of international treaties to which the Czech Republic is bound. Furthermore, the thesis deals with the view of the European Court of Human Rights on the issue of artificial termination of pregnancy. The European Court of Human Rights has dealt with this topic several times in its decision-making practice, and therefore the thesis describes in detail the most important judgments. Subsequently, it also analyses the situation regarding abortion in individual European countries. The events of the past year have meant that the thesis also includes the still evolving situation regarding the issue of abortion in the USA. The thesis therefore includes a chapter on the US Supreme Court and its view on the issue of abortion. As the highest level of the federal judiciary in the United States, the U.S. Supreme Court issues binding precedents that have legal consequences throughout the United States. On abortion, it has issued three major precedents, Roe v. Wade, Casey v. Planned Parenthood, and most recently Dobbs v. Jackson Women's Health Organization, which caused the abrogation of the federal right to abortion and resulted in the issue of abortion once again being decided by the individual US states themselves. The final chapter of the thesis therefore traces the current position of these states on the issue of abortion.
