Aspects of legal correlation in cooperative system of the Czech republic

Abstract:

Cílem této bakalářské práce bylo vymezit teoretický rámec bytového družstevnictví České republiky definovaný současnou platnou legislativou. V teoretické části práce se zabývám právní charakteristikou bytového družstevnictví a jeho historií , dále základními otázkami právní úpravy družstev od jejich založení či vstupu do družstva, přes práva a povinnosti družstevníků, až po zánik družstva či členství v něm. Pozornost jsem věnovala i aktuální problematice převodů bytů do osobního vlastnictví včetně porovnání vlastnictví osobního s družstevním. V poslední kapitole jsem se zaměřila na aplikaci teoretických poznatků v praxi. Pro porovnání jsem si vybrala Stavební bytové družstvo Družba Pardubice.

Abstract:

The goal of this bachelor essay was to specified potential framework of the cooperative system of the Czech Republic which is defined by current valid lagislation. In the theoretical part I dealt with legal characterization of the cooperative system and its history. Next I dealt with the basic problems of legal amendment of cooperatives from their establishment or entering to the cooperative over the rights and duties of co-op members to the expiry of cooperative or the membership in it. I paid attention to the current problems of flat assigments into the several estate including the comparision of several estate and cooperative, as well. In the last chapter I targeted to the using of theoretical findings. I chose The bulding society Družstvo Pardubice as an example.
