The Problem of the Moral Neutrality of Liberal Democracy: A Natural Law Response to Neutralism and Liberal Perfectionism

Abstract:

Táto dizertačná práca argumentuje z pozície prirodzenoprávnej teórie, že štát má rolu vo vytváraní a udržiavaní podmienok v ktorých môžu občania žiť hodnotné životy. V súčasnej politickej teórii je táto pozícia kategorizovaná ako perfekcionistická, v kontraste s anti-perfekcionizmom alebo neutralizmom, ktorý tvrdí, že štát by nemal explicitne alebo implciitne hodnotiť rôzne životné štýly alebo plány. Dôsledky tejto debaty sú dôležité, od legitimity štátnej podpory pre umenie alebo šport, cez status náboženských názorov v politike, až po to, aké argumenty sú prípustné v takzvaných kultúrnych vojnách. Autor má za cieľ obhájiť verziu prirodzenoprávneho perfekcionizmu vyvrátením najlepších nedávnych argumentom proti nemu, prehodnotením konceptov zásadných pre debatu a formulovaním pozitívneho argumentu pre existenciu perfekcionistických povinností štátu. Protiargumenty majú pôvod v anti-perfekcionistických, ako aj alternatívnych perfekcionistických pozíciách. Politický liberalizmus, reprezentovaný Jonathanom Quongom, tvrdí, že perfekcionistické politiky sa dopúšťajú nerešpektu vočí morálnemu statusu osôb a ignorujú fakt rozumnej nezhody o tom, čo je dobrý život. Avšak rešpektovanie osôb a hĺbky ich nezhody nemôže poskytnúť principiálny, neprevážiteľný argument proti rozvážnym perekcionistickým zásahom. Collis Tahzib, priekopník „politického perfekcionizmu“, argumentuje, že existujú perfekcionistické hodnoty, ktoré by mali zdieľať všetci rozumní ľudia, ale tiež také, ktoré zostávajú predmetom rozumnej nezhody. Ale ak to znamená, že niektoré rozumné úsudky o dobrom ľudskom živote sú prípustné ale iné nie, táto pozícia vážne riskuje arbitrárne vylúčenie legitímnych úsudkov. Matther Kramer, proponent „ašpiračného perfekcionizmu“ tvrdí, že väčšina ostatných perfekcionistických teórií prejavuje všetečnú mentalitu a snaží sa ovplyvniť záležitosti ktoré nespadajú do povinností vlády. Pozitívny argument tejto dizertačnej práce vyvracia túto námietku. Základnou úlohou štátu je zabezpečiť spoločné dobro, chápané ako súbor podmienok v ktorých sa ľudia môžu snažiť o plnenie ich rozumných cieľov. To zahŕňa ochranu práv a verejnéhp poriadku, ale aj nadobúdanie inherentne hodnotných – perfekcionistických – dobier, a ak štát odpovedá na skutočnú potrebu podporiť ľudí v týchto snahách a robí to rozvážnym spôsobom rešpektujúcich okolnosti, plní svoju základnú úlohu.

Abstract:

This dissertation argues from the position of the natural law theory that the state has a role in creating and maintaining conditions in which its citizens can live valuable lives. In contemporary political theory, this position is categorized as perfectionist and contrasts with anti-perfectionism or neutralism, which is the belief that the state should not explicitly or implicitly evaluate the worthiness of different lifestyles or life plans. The consequences of this debate are significant, ranging from the legitimacy of the state support of arts or sports, the place of religious views in politics, all the way to what arguments are permissible in the so-called culture wars. The author seeks to defend a version of natural law perfectionism by tackling the best recent arguments against it, re-evaluating the concepts fundamental for the debate, and providing a positive argument for the existence of perfectionist duties of the state. The counter-arguments come from both anti-perfectionist and rival perfectionist positions. Political liberalism, represented by Jonathan Quong, argues that perfectionist policies disrespect the moral status of the person and disregard the fact of reasonable disagreement about what comprises a good life. However, respect for persons and the depth of their disagreement cannot provide a principled, indefeasible argument against prudent perfectionist measures. Collis Tahzib, a pioneer of ‘political perfectionism’, argues that there are perfectionist values that all reasonable people can share, but also that some perfectionist remain the subject of reasonable disagreement. But if this means that some sound judgments about human flourishing are permissible but other sound judgments are in principle impermissible, than this position runs a serious risk of arbitrarily excluding legitimate judgments. Matthew Kramer, a proponent of ‘aspirational perfectionism’, suggests that most other perfectionist theories exhibit a busybody mentality and seek to affect matters that are not within the government’s duties. The positive argument of this dissertation seeks to rebut this challenge. The state’s fundamental duty is to secure the common good – a set of conditions in which people can pursue their reasonable goals. This includes the protection of rights and public order, but also the pursuit of intrinsically valuable – perfectionist – goods, and if the state responds to a genuine need to assist people in these pursuits, and does so in a prudent manner respective of the circumstances, it fulfils this fundamental obligation.
