Investor and Environment - the Legal Aspects

Abstract:

Cílem této práce je popsat proces realizace konkrétního typu obnovitelného zdroje energie z pohledu možných střetů investora s legislativou z oblasti práva životního prostředí. Vzhledem k profesnímu zaměření diplomanta a aktuální situací na českém trhu je proto práce zaměřena na popis právní úpravy postupu, kterým musí projít investor hodlající realizovat výstavbu výrobny elektrické energie ze slunečního záření, nebo-li fotovoltaickou elektrárnu. Práce proto ve svém úvodu nejprve stručně seznamuje s právní úpravou oblasti obnovitelných zdrojů energie a to zejména s výše uvedenou evropskou směrnicí a její transpozicí do našeho právního řádu prostřednictvím příslušných právních předpisů. V dalších kapitolách potom práce obecně definuje fáze realizace investiční akce výstavby fotovoltaické elektrárny a nastiňuje problémové okruhy a možná místa „střetů“ s právem životního prostředí. Na základě zkušeností diplomanta, je tak jako klíčová fáze procesu přípravy záměru výstavby fotovoltaické elektrárny definována fáze schvalovací, ve které dochází k největším nárokům na investora, co se týče souladu jeho projektu s jednotlivými složkami životního prostředí. V této fázi, během územního a stavebního řízení, totiž musí investor vyhovět celé řadě požadavků orgánů ochrany přírody i dalších institucí vyjádřených v tzv. závazných stanoviscích. Ve své hlavní části rozebírá diplomová práce již podrobně jednotlivé fáze procesu přípravy a vzniku fotovoltaické elektrárny, věnuje se podrobně jednotlivým kritickým bodům procesu, které dále rozebírá nejen z teoretického hlediska, ale také prostřednictvím kritického posouzení konkrétních případů a situací, se kterými přišel diplomant do styku během své pracovní kariéry a přípravy této diplomové práce. Jednotlivé případy jsou tak na pozadí platné legislativy a získaných teoretických právních předpisů podrobeny kritické analýze diplomanta a obsahují také jeho právní názor na danou problematiku. Diplomová práce tak představuje ucelený pohled na proces přípravy projektu fotovoltaické elektrárny a to včetně řešení konkrétních praktických příkladů, se kterými se mohou investoři během své investiční činnosti setkat.

Abstract:

The goal of this paper is to describe the procedure of a particular type of renewable energy resource from the view of the investor and his possible disagreement with legislation in the area of environmental laws. Due to a professional focus of the candidate and recent situation of the Czech Republic market, this paper focuses on the description of legal modifications to the procedure that the investor must pass in order to carry out a building of solar radiation / photovoltaic power plant. This paper briefly introduces the legal rights and its procedures in the area of renewable resources, focusing on the EU directive mentioned above and its integration into the Czech legal system and its respective directives and rules. This paper will also describe individual phases of the photovoltaic power plant building realization and its investor, outlining possible trouble areas and potential disagreement with environmental laws and directives. Based on the candidate´s experience, the key phase of the whole process of photovoltaic power plant building is the phase of approval where the biggest demands are placed on the investor. In this phase, the investor and its project must meet all directives of environmental legal rights system. In this phase, during the spacial/territory and building planning, the investor must meet a variety of requirements concerning the environmental and related rights. These requirements are stated in so called binding assessments. In the main part of the paper, there is a detailed description of individual phases: the preparation of photovoltaic power plant focusing on individual, critical aspects of the process. These aspects have been analyzed theoretically as well as through critical judgement of the candidate, who has experienced the critical problems in his career thus far. These individual cases have been critically analyzed with regard to the legal right system of the C|R by the candidate and contain his legal opinion on particular issues. This paper introduces a concise view on the process of photovoltaic power plant preparation including solving particular examples that the investors might require.
