Comparison of Personal Income Tax in the Slovak Republic and the Czech Republic

Abstract:

In the present diploma thesis, we deal with the problems of taxation of incomes both on the theoretical, and the practical levels. The main idea of the this work is to compare taxation of personal incomes in the Slovak and the Czech Republics in compliance with the applicable legislation valid as to the date of December 31st, 2008 and all the amendments thereto as to the date of March 31st, 2009. In consideration of a broad extent of the subject at hand, we analyze only a selected part of the income tax act in the Slovak Republic and the income tax act in the Czech Republic.When analyzing such tax legislative norms, we must also not forget to take into account theoretical definitions and terms especially related to income taxes. Membership of both countries in the European Union, in particular, does not allow for omitting the process of harmonization of the European law in the field of direct taxes. At present time, creation of a unified system of taxation within the framework of the member-states of the European Union does not seem to be a real one. Though the economic crisis press upon the member-states to mutually coordinate their measures and steps which would help to overcome financial problems of all the member-states, individual governments of such states are not yet ready to become united in the field of the policy of taxation, because the sphere of public finance (their management and control) has always been considered as an autonomous and preferential one.

Abstract:

V diplomovej práci sa zaoberáme problematikou zdaňovania príjmov v teoretickej aj v praktickej rovine. Hlavnou myšlienkou práce je porovnať zdaňovanie príjmov fyzických osôb v Slovenskej a Českej republike v súlade s platnou legislatívou k 31.12.2008 a jej zmenami k 31.3. 2009. Vzhľadom na širokú rozsiahlosť tejto témy analyzujeme len vybranú časť zákona o dani z príjmov v Slovenskej republike a zákona o dani z přijmů v Českej republike. Pri analýze týchto daňových legislatívnych noriem nesmieme zabúdať aj na teoretické vymedzenia a pojmy predovšetkým súvisiace s dôchodkovými daňami. Členstvo oboch krajín v Európskej únii nám nedovolí osobitne neupozorniť na proces harmonizácie európskeho práva v oblasti priamych daní. Tvorba jednotného daňového systému v rámci štátov Európskej únie sa v súčasnosti zdá nereálna. Hospodárska kríza síce núti členské štáty vzájomne koordinovať svoje opatrenia a kroky, ktoré by pomohli prekonať finančné problémy všetkých členských štátov, ale jednotlivé vlády týchto krajín nie sú pripravené zjednotiť sa v oblasti daňovej politiky, pretože oblasť verejných financií (ich riadenie a kontrolu) považujú za autonómnu a prioritnú.
