A Well in the Light of the Legal Regulation

Abstract:

Cílem práce je analýza současné právní úpravy studny a odebírání podzemní vody z ní. Práce je zaměřena na postup při zřizování nové studny, její užívání a nakládání se studnou jako s předmětem vlastnictví. Vychází jak z platné legislativy, tak i z judikatury, právní a technické literatury a praxe. Přínos práce spočívá v uceleném zachycení právních norem upravujících vznik studny, nakládání s ní a odběry podzemní vody ze studny.

Abstract:

The aim of this thesis is to analyze an actual legal regulation of wells and underground water taking. The thesis is focused on sinking a new well, its usage and treating it like one´s property. It is not only based on an actual legislation, but also on jurisprudence, legal and technical literature and practise. Asset of the thesis is a comprehensive picture of legal regulation concerning sinking a well, treating a well and taking of underground water from a well.
