Legal Action for Disputing Parentage

Abstract:

Ve své diplomové práci se zabývám problematikou žaloby na popření otcovství, konkrétně nalezením rozdílů mezi českým a německým právním řádem v této oblasti rodinného práva. Hlavním cílem diplomové práce je nalézt zásadní rozdíl, jímž je tzv. padělání občanského stavu dle německého trestního zákona, stanovení pozitiv a negativ tohoto institutu a návrh zavedení do právního řádu České republiky. Je zde využíváno metod analýzy, syntézy a především komparace, a to konkrétně nového občanského zákoníku s německým občanským zákoníkem tzv. BGB a německým trestním zákonem StGB. Vedlejším cílem práce je dále pak úvaha nad problematikou práva popřeného otce na styk s dítětem dle českého právního řádu a následný návrh řešení.

Abstract:

This diploma thesis deals with the issue of lawsuits against the denail od paternity. It also focuses on finding the fundamental differences between the Czech and German Legal Systems of Family law and on forgery of civil status under the German Criminal Code. It is also determines the advantages and disadvantages of this institute and proposes its introduction to the Criminal Code of the Czech Republic. Various methods such as analysis, synthesis and comparison have been used troughout this diploma thesis to better compare the New Civil Code with the German Civil Code, the so-called BGB Code and the German Criminal Code StGB. The secondary goal of the thesis is to consider the impact of the denail of paternity on the child contact with respect to the Czech Legal System and the subsequent solution propositions.
