Alternative Dispute Resolution in the Financial Sector in the Czech Republic

Abstract:

Tématem bakalářské práce je mimosoudní řešení sporů ve finanční oblasti v ČR. Snažím se čtenáři zprostředkovat komplexní pohled na tuto problematiku. V detailu se poté práce zaměřuje na několik nejvýznamnějších možností pomocí, kterým lze takovéto spory řešit. Nejrozsáhlejší kapitoly jsou proto věnovány mediaci, rozhodčímu řízení, finančnímu arbitrovi a zcela zvláštní částí je potom kapitola o projektu mimosoudního řešení spotřebitelských sporů. V práci je komplexní shrnutí všech možností, které Česká legislativní úprava zohledňuje jako alternativní, tedy mimosoudní řešení sporů. Ovšem nejsou zmíněny jen metody upravené v legislativě, ale i možnosti, které strany sporu mohou samy využít předtím, než se rozhodnou pro řešení svého sporu za pomoci třetích osob. Samozřejmě je zde uvedeno jisté srovnání jednotlivých metod ADR a to jak mezi sebou tak i v návaznosti na soudní řízení. Ač tématem práce nejsou spotřebitelské spory, i tak s ní úzce souvisejí, a proto je poslední kapitola zaměřená na projekt, který právě toto alternativní řešení spotřebitelských sporů obsáhl komplexněji a snaží se sdružit jednotlivé metody ADR tak, aby klient postupoval v rámci projektu od toho nejméně agresivního řešení, jímž je třeba partnerství, až po metody, kterými je rozhodčí řízení, a nebo řízení před finančním arbitrem.

Abstract:

The theme of this work is alternative dispute resolution in the financial sector in the Czech republic. Trying to convey the reader a comprehensive view on this issue. In detail, the following work focuses on several major options through which such disputes can be resolved. The largest chapter is therefore devoted to mediation, arbitration, financial arbiter and a very special part is then a chapter on project-court settlement of consumer disputes. This work is a comprehensive summary of all the possibilities that the Czech legislative change reflects as an alternative, that alternative dispute resolution. But not only mentioned methods provided for in legislation but also the possibility that the parties may themselves use before they decide to settle their dispute with the assistance of third parties. Of course, there is shown a comparison of certain methods of ADR, both among themselves and in relation to legal proceedings. Although not to the work of consumer disputes, and so closely related, and therefore is the last chapter on a project that is this alternative dispute resolution for consumer disputes encompass complex and tries to bring together the various ADR methods so that the client within the project progressed from the least aggressive solution, which should be the partnership, to the methods by which the arbitration proceedings or proceedings before the Financial Arbitrator.
