Employment contracts and agreements on works performed outsider of the employment relationship

Abstract:

This dissertation is focused on the general characteristics of the Labour Law and the determination of legal labour relations within the framework of a Employment Contract. The dissertation will explain the principle of freedom of a contract as well as flexibility of a job market. The Labour Code in the Slovak Republic has gone through certain changes in the past years which have influeced the content of the Employment Contract embodying the relation between the employer and the employee. The Labour Code is the essential decree followed by millions of employees and hundreds of thousands of employers in the republic. The dissertation provides the theoretical overview of the Employment Contract, its appurtenances and outlines the types of the Employment Contracts. Agrements on work performed outside of the employment relations have been analysed and described. The first chapter is devoted to the system of contracts in the Labour Law which is afterwards compared to the Civil and the Labour Code. The second chapter describes the process of closing of contracts, analyses the Employment Contract and Agreements on work performed outside of the employment relations. The third and the final chapter is focused on the flexibility in the Labour law.

Abstract:

Bakalárska práca sa zaoberá všeobecnou charakteristikou pracovného práva a vymedzením pracovnoprávnych vzťahov v súvislosti s pracovnou zmluvou. V práci vysvetlíme zásadu zmluvnej voľnosti a tiež flexibilitu trhu práce. Zákonník práce v Slovenskej republike prešiel v posledných rokoch určitými zmenami, ktoré mali vplyv na obsah pracovnej zmluvy vyjadrujúcej vzťah medzi zamestnávateľom a zamestnancom. Zákonník práce je základným predpisom, ktorým sa v republike riadia milióny zamestnancov a stovky tisíc zamestnávateľov. V bakalárskej práci je teoretický pohľad na pracovnú zmluvu, jej náležitosti a typy pracovných zmlúv. Jednotlivé dohody o prácach vykonávaných mimo pracovného pomeru sme sa snažili analyzovať a opísať. Prvá kapitola je venovaná zmluvnému systému v pracovnom práve, kde porovnáme zmluvný systém v pracovnom práve s občianskym právom a zákonníkom práce. V druhej kapitole opisujeme proces uzatvárania zmlúv , analyzujeme pracovnú zmluvu a jednotlivé dohody o prácach vykonávaných mimo pracovného pomeru. Tretia, posledná kapitola sa zaoberá flexibilitou v pracovnom práve.
