Abuse of dominant position in the decision-making practice of antitrust authorities

Abstract:

Předmětem mé diplomové práce je zneužití dominantního postavení, jakožto jedna z hlavních forem nedovoleného omezování hospodářské soutěže. Zaměříme-li svou pozornost blíže na příslušnou právní úpravu, zjistíme, že je plná neurčitých právních pojmů, jejichž vymezení tvůrce předpisu nikde nepodává. K definování těchto klíčových pojmů (jako podnik, dominantní postavení, zneužití, relevantní trh a ovlivnění obchodu mezi členskými státy) došlo až následně, v rozhodovací praxi příslušných soutěžních autorit. A právě analýza relevantní judikatury, její zhodnocení a vyvození obecnějších závěrů, z ní vyplývajících, je středobodem mé práce. Krátce se také věnuji některým zástupcům "nového přístupu" k čl. 102 SFEU, jako jsou koncept "stejně výkonného soutěžitele", institut "objective justification" a institut "efficiencies".

Abstract:

The aim of my thesis is abuse of dominant position as one of the main forms of illegal restriction of economic competition. If we focus our attention closer to the relevant legal regulation, we find that it is full of vague legal concepts as the lawmakers did not explain the detailed of the regulations anywhere. The definition of these key concepts (as undertaking, dominant position, abuse, relevant market and affect trade between Member States) happened subsequently, in practise, by decision-making of antitrust authorities. And it is the analysis of relevant case law, its evaluation and more general conclusions derived from it, that is the centerpiece of my work. I have also briefly introduces some of the examples of the new approach to Article 102, e.g. the concept of "as efficient competitor" and the aceptable methods of defence of dominant companies, which represents the institute of "objective justification" and institute of "efficiencies".
