The Transformation of the Convention on the Law applicable on the Contracts into the Regulation

Abstract:

Témou tejto diplomovej práce je transformácia Dohovoru o práve rozhodnom pre zmluvné záväzky do nariadenia. Rímsky dohovor je medzinárodná zmluva, zmluvnými stranami ktorej sú členské štáty ES, ktorá na úrovni Spoločenstva unifikuje kolízne pravidlá pre určenie rozhodného práva pre zmluvné záväzky. Jeho prijatie predstavovalo prvý krok k unifikácii a kodifikácii kolíznych noriem pre oblasť súkromného práva v Spoločenstve. Cieľom tejto diplomovej práce je priblížiť pôvodnú a novo navrhovanú úpravu určenia rozhodného práva na úrovni Spoločenstva, ako aj s dôvody, ktoré stáli za prijatím pôvodného Dohovoru, jeho premenou na komunitárny nástroj, a za zmenami jednotlivých ustanovení. Práca je formálne rozčlenená do šiestich kapitol. Prvá kapitola sa zaoberá budovaním európskeho justičného priestoru ako predpokladu k prijatiu ako pôvodného textu Dohovoru, tak aj nového návrhu nariadenia. Druhá kapitola bližšie približuje históriu samotného Dohovoru, jeho štruktúru a piliere, na ktorých je jeho úprava postavená. V tretej kapitole sa zaoberám dôvodmi a skutočnosťami, ktoré Komisiu viedli k predloženiu návrhu premeny Dohovoru na komunitárny nástroj a výhodami, ako aj ťažkosťami, ktoré by so sebou takáto zmena priniesla. Ťažiskom práce sú kapitoly štyri až šesť venované úprave hlavných pilierov, na ktorých Dohovor a návrh stoja. V týchto kapitolách sa pokúsim priblížiť pôvodnú úpravu v Dohovore, problémy, s ktorými sa stretávala aplikačná prax pri používaní týchto inštitútov a následne spôsob, ako na uvedené problémy a nedostatky pôvodnej úpravy reaguje návrh nariadenia. Diplomová práca je spracovaná podľa právneho stavu ku dňu 01.08.2006.

Abstract:

The theme of this thesis is the transformation of the Rome Convention on the Law Applicable to Contractual Obligations into a Regulation. The Rome Convention is an international convention unifying conflict rules in the European Community. The thesis describes the original text of the Convention and compares it to the proposed text of the regulation. It also tries to outline the reasons behind the initiative to transform the current convention into a community regulation and advantages and disadvantages of such step. The work is formally divided into six chapters. The first chapter deals with the creating of European judicial area as a precondition of creating the original Convention and it current transformation process. The second chapter describes the Rome convention in more detail – the history of the adoption, its structure and main principles on which it is built. The reasons behind the transformation process are dealt with in the third chapter. The last three chapters concern the three main principles of the Convention – autonomy of the parties to select the applicable law, closest connection principle and safeguarding of internationally mandatory rules. First they describe in more detail the regulation of these principles in the current Convention, then they try to point out the main problems that were met with the application of the relevant articles of the convention and lastly they show how the new proposed regulation deals with the above mentioned problems and difficulties.
