The problem of the legal status of the Caspian Sea and its impact on the regional diverzification projects in energy infrastructure - the case of Trans-Caspian Gas Pipeline

Abstract:

Magisterská práce se zabývá analýzou sporu o právní status Kaspického moře a jeho souvislost s diverzifikačními projekty v regionu. Jako příklad diverzifikačního projektu byl zvolen projekt Transkaspického plynovodu mající převážet zemní plyn přes Kaspické moře z Turkmenistánu do Ázerbájdžánu. Aby rozpoznat, zda spor o právní status Kaspického moře ovlivňuje realizaci, či ne realizaci projektu, autor si rozhodl definovat spor o právní status Kaspického moře jako surovinový konflikt. Pro užší vymezení téma práce autor se zaměřuje pouze na určitý typ energetické suroviny – zemní plyn. Celkově práce je rozdělena do čtyř velkých kapitol. První kapitola je teoretická, kde autor vymezil základní pojmy a indikátory definice surovinového konfliktu. Druha kapitola je věnována energetickému potenciálu Kaspického moře a jeho pobřežních států. Dana kapitola je především orientována na zásoby zemního plynu v regionu. Cílem kapitoly je vymezit oblast střetu zájmů mezi pobřežními státy. Třetí kapitola je věnována mezinárodnímu sporu o právní status Kaspického moře. Cílem této kapitoly je dokázat, že dany spor lze považovat za surovinový konflikt. V rámci čtvrté kapitoly byl zanalyzován průběh vývoje projektu Transkaspického plynovodu. Cílem této kapitoly bylo ukázat význam daného projektu pro Kaspický region a postoj pobřežních států k projektu. Na závěru práce autor odpověděl na hlavní stanovené výzkumné otázky a ověřil tvrzení, jestli mezinárodní právní status Kaspického moře souvisí s realizace, či ne realizace projektu Transkaspického plynovodu. Abstract:

The master thesis analyzes the dispute over the legal status of the Caspian Sea and its connection with diversification projects in the Caspian region. As an example of diversification project, author to choose the Trans-Caspian Gas Pipeline project, which must transport natural gas across the Caspian Sea from Turkmenistan to Azerbaijan. To identify whether the dispute of legal status of the Caspian Sea affects the realization or non- realization of the project, the author decided to define a dispute over the legal status of the Caspian Sea as a resource conflict. The author focuses only on a particular type of energy resource - natural gas. Overall, the work is divided into four major chapters. The first chapter is theoretical, where the author defined the basic concepts and definitions of the indicators of resource conflict. The second chapter is devoted to the energy potential of the Caspian Sea and its coastal states. The chapter is primarily focused on natural gas reserves in the region. The aim of this chapter is to define the area of conflict of interest between coastal states. The third chapter is devoted to the international dispute over the legal status of the Caspian Sea. The aim of this chapter is to show that the dispute in question can be considered as resource conflict. In the fourth chapter, the author analyzed the course of development of the Trans-Caspian Gas Pipeline project. The aim of this chapter is to show the importance of the project for the Caspian region and the attitude of coastal states to the project. At the conclusion, the author answered the main research questions and verified claims if the international legal status of the Caspian Sea is related to the implementation of the Trans-Caspian Gas Pipeline project.
