The Way to the Enforcement of Judgements in International Procedural Law (the Position of so called Other Regulations after Nullifying the Declaration of Enforceability as Part of the Brussels I Recast Regulation)

Abstract:

Práce se zabývá problematikou uznání a výkonu cizích soudních rozhodnutí ve věcech občanských a obchodních po vstupu v účinnost Nařízení Brusel Ibis. Práce je zaměřena na proces uznání a výkonu dle tzv. dalších procesních nařízení (nařízení o evropském exekučním titulu, nařízení o evropském platebním rozkazu a nařízení o drobných nárocích), který je srovnáván s procesem uznání a výkonu dle Nařízení Brusel Ibis. Cílem je ověření hypotézy, zda tzv. další procesní nařízení přinášejí výhody i po zrušení řízení o prohlášení vykonatelnosti u Nařízení Brusel Ibis.

Abstract:

The thesis deals with the recognition and enforcement of foreign judgments in civil and commercial matters after the Brussels I Recast Regulation entered into force. The thesis is focused on the process of recognition and enforcement according to so called other procedural regulations (the Regulation creating a European Enforcement Order for uncontested claims, the Regulation creating a European order for payment procedure and the Regulation establishing a European Small Claims Procedure) which is compared to the process of recognition and enforcement under the Brussels I Recast Regulation. The aim is to verify the hypothesis whether the so called other procedural regulations bring benefits even after nullifying the declaration of enforceability as part of the Brussels I Recast Regulation.
