Abstract:

Diplomová práce je zaměřena na problematiku transferových nebo převodních cen, která je v současné době velmi aktuálním a diskutabilním tématem. Transferové ceny jsou ceny používané při transakcích mezi spojenými osobami nebo sdruženými podniky v rámci velké nadnárodní korporace. Hlavním cílem stanoveným v rámci diplomové práce je detailně prozkoumat problematiku stanovení transferových cen v mezinárodním podnikání, posoudit, jaký dopad mají na finanční situaci podniku jako hlavní nástroj daňové optimalizace a identifikovat klíčové otázky související se sestavením přehledné a důvěryhodné dokumentace k transferovým cenám. Základem pro vypracování diplomové práce sloužila Směrnice OECD pro nadnárodní korporace a orgány finanční správy (angl. OECD Transfer Pricing Guidelines for Multinational Enterprises and Tax Administrations), která obsahuje komplexní úpravu převodních cen a zároveň stanovuje metody pro posouzení správnosti nastavení transferových cen mezi propojenými podniky.

Abstract:

Diploma thesis is focused on the transfer pricing, which is currently very topical and hotly contested issue. Transfer prices are the prices used in transactions between related entities or associated enterprises within a large multinational corporation. The main objective of this thesis is to explore the issue of determination of transfer prices in the framework of international business, assess the impacts they have on the financial situation of the enterprise as the main tool of tax optimization and to identify the key issues associated with compilation of a clear and credible transfer pricing documentation. The basis for the preparation of the thesis were The OECD Transfer Pricing Guidelines for Multinational Enterprises and Tax Administrations, which contain comprehensive regulation of transfer prices and at the same time determine the methods for the correct setting of transfer prices between related enterprises.
