The hedging and reimburse function of right of lien

Abstract:

Cílem této diplomové práce je zanalyzovat institut zástavního práva ve světle zajišťovací a uhrazovací funkce, jakožto jeho zásadních funkcí a poukázat na možnosti využití zástavního práva v praxi. Práce je členěna do sedmi kapitol. Úvod druhé kapitoly je věnován zástavnímu právu v kontextu zajišťovacích institutů jako takových a v kontextu jeho právní úpravy v rámci občanského zákoníku. V následující části druhé kapitoly byl popsán historický vývoj zástavního práva. Poslední část druhé kapitoly je zaměřena na zásady, subjekty a vznik zástavního práva. Předmětem třetí kapitoly je zajišťovací funkce zástavního práva a dopad jednotlivých složek zajišťovací funkce na subjekty zástavněprávního vztahu. Čtvrtá kapitola objasňuje význam uhrazovací funkce zástavního práva a podává detailní rozbor, jak lze zástavní právo realizovat.Pátá kapitola je věnována zániku zástavního práva a institutům zástavního práva, pro jejíž aplikaci je zánik zástavního práva předpokladem. Obsahem šesté kapitoly je analýza zástavního práva v rámci insolvenčního řízení a dopad na jeho zajišťovací a uhrazovací funkci.

Abstract:

The aim of this thesis is to analyze the institute of lien in the light of the hedging and reimburse function as its essential functions and point out the possibility of using the lien in practice. The thesis is divided into seven chapters. The introduction of the second chapter is devoted to the lien in the context of reinsurance institutes as such and in the context of its legislation within the Civil Code. The following part of the second chapter describes the historical development of the lien. The last part of the second chapter focuses on the principles, subjects and the emergence of liens. The subject of the third chapter is the hedging function of the lien and the impact of individual components of the hedging function on subjects of the lien. The fourth chapter explains the meaning of the reimburse function and gives a detailed analysis of how the lien can be realized. The fifth chapter is devoted to the extinction of the right of lien and the institutes of the right of lien, for whose application the extinction of the right of lien is a prerequisite. The content of the sixth chapter is the analysis of the lien within the insolvency proceedings and the impact on its hedging and reimburse function.
