Asylum-seekers: The Protection under Article 3 of the European Convention on Human Rights
Abstract:
Diplomová práce se zabývá zákazem vyhoštění dle článku 3 Evropské úmluvy o lidských právech. Text Úmluvy výslovně neobsahuje zákaz vyhoštění, ale evropští soudci interpretují článek 3 tak, že zakazuje vyhoštění, hrozí-li osobě mučení, nelidské nebo ponižující zacházení anebo trest.
Abstract:
This thesis deals with the prohibition of expulsion under Article 3 of the European Convention on Human Rights. Text of the Convention contains no explicit prohibition of expulsion, but European judges interpret Article 3 so that it prohibits the expulsion, if there is a risk for the person to be submitted to torture, inhumane or degrading treatment or punishment.
