Systemic Bias of Public Officials

Abstract:

Diplomová práce přibližuje institut podjatosti úředníků ve správním řízení, s tím, že poukazuje na základní důvody, pro které je tento institut tradičně v procesních úpravách obsažen. Dále se věnuji tzv. systémové podjatosti, kdy v prvé řadě pojmově vymezuji, co se tzv. systémovou podjatostí rozumí, a poté se zabývám tímto institutem, jak z pohledu právně teoretického, tak z pohledu pozitivně právní úpravy, a stejně tak i z pohledu aktuální judikatury. Mé pojednání vyúsťuje ve zhodnocení právního stavu dané problematiky, jakož i v námětech a doporučení do budoucna.

Abstract:

This thesis approaches the bias institute officials in administrative proceedings, that points to the underlying reasons for this Institute is traditionally included in the editing process. Next I attended so. Systemic bias, which primarily conceptually define what is called. Systemic bias means, and then deal with this institute, both in terms of legal theory and in terms of positive legislation, as well as from the perspective of the current case. My treatise culminates in the appreciation of the legal status of the issue, as well as suggestions and recommendations for the future.
