The termination of residential lease

Abstract:

V mé diplomové práci se věnuji problematice bydlení se zaměřením na zánik nájmu bytu. K tomuto konkrétnímu zaměření mne přivedly především dvě zásadní novely, a to 1. zákon č. 107/2006 Sb., o jednostranném zvyšování nájemného z bytu a o změně zákona č. 40/1964 Sb.,občanského zákoníku, ve znění pozdějších předpisů a 2. zákon č. 115/2006 Sb., o registrovaném partnerství a o změně některých souvisejících zákonů, které se významně dotkly ustanovení zákona č. 40/1964 Sb., občanský zákoník v pozdějším znění (dále jen „OZ“) o nájmu bytu. Cílem mé diplomové práce je rozbor a zhodnocení jednotlivých způsobů zániku nájmu bytu.

Abstract:

In my thesis, I applied to problems of housing with a special intent on the termination of lease. One of the main reason for the selection of the topic of my thesis was an amendment of the Civil Code which carried out by the Act n. 107/2006 which went into force on 31st March 2006. The objective of my thesis was therefore the analysis of several means of termination of lease, herewith the classification of changes which the amendment carried out. Changes carried out in the area of termination of lease are very important, because leads to the proportional balanced relationship between landlord and tenant. Especially a cancellation of the obligation of the assent of the court with o notice given by landlord, so of course this change keeps from an unnecessarily large agenda of tenancy causes in a court and lightens overload Czech courts.
