Piracy and maritime robbery in the Baltic between 10th and 16th century

Abstract:

Diplomová práce pojednává o problematice pirátství ve středověku, se speciálním důrazem na právní kvalifikaci a klasifikaci. Soustředí se geograficky na region Baltského more, zejména pak dnešní severní Německo. Zaprvé je přednesen obecný a současný diskurs. Mezinárodněprávní regulace je představena spolu se základními problemy, kterými trpí. Následně je provedeno zobecnění skutkové podstaty k definici její obecné podstaty. Ta je poté použita k vymezení trendů, vážících se k pirátství. Následně jsou představena základní paradigmata teorie pirátství jak Augustinské, tak Ciceronovské. Hlavním cílem práce je nicméně analýza jak právní regulace mezi 10. a 16. stoletím, tak vůbec její vymezení. K tomu jsou využity jak právní, tak i některé neprávní zdroje. Takto jsou pak analyzovány Činy biskupů hamburskéhokostela a Život svatého Anskara, ale take Lex Frisionum. Hlavní analyzovaný korpus však tvoří Hanzovní recesy, akty na ně navázané a akce nazákladě těchto dokumentů podniknuté. Poté jsou rozebrány problémy týkající se licencovaného pirátství kapérství. Ty jsou analyzovány na základě tehdejších právních aktů. Nakonec je předložena analýza trestu polomytické postavy Klause Störtebekera, odsouzeného za námořní loupež ve městě Hamburku na počátku patnáctého století.

Abstract:

The thesis discusses issue of piracy in middle ages, with special regards to law qualification and classification. It focuses geographically on the region of the Baltic Sea, especially today's northern Germany. First, the general and current discourse is presented. The international regulation of piracy is outlined, with some problems it causes. Then a generalisation of actus reus of piracy is done by extrapolating its very general categories. They are then used to outline trends in piracy. Then the fundamental paradigms of a pirate are presented the Augustinian and Ciceronian. However, main objective of work is to present both law regulations of piracy between 10th and 16th centuries and to analyse them. To achieve it, not only sources of law are used, but also some non-legal sources. This way the Gesta Hamburgensis and Life of Anskar are analysed, as well as Lex Frisionum. Focus is especially given to analysis of Hanseatic Recesses and other acts related to them, as well as actions undertaken on their behalf. Then are also discussed issues of licensed piracy privateering, and problems associated with it. These are presented in various contemporary legal acts. Finally, brief summary of punishment of semi-mythical Klaus Störtebeker for maritime robbery in Hamburg is presented.
