Abstract:

Bakalářská práce na téma „Vymáhání práv z průmyslového vlastnictví v ČR“ se zabývá aktuálními trendy v teoretické i praktické rovině ochrany práv z průmyslového vlastnictví v ČR se zřetelem na ochranu práv z ochranné známky v souvislosti s výrobou a distribucí padělků významných značek. Vychází ze současného právního rámce pro tuto oblast, mapuje institucionální zajištění a programovou podporu a popisuje rovněž způsoby, jak se zboží porušující práva majitelů ochranných známek do České republiky dostává a jak je zde distribuováno. Práce rovněž důkladně hodnotí soukromoprávní, správní a trestněprávní rovinu, respektive procesy, které směřují k ochraně majitelů práv v jednotlivých právních odvětvích. Krátce se rovněž zmiňuje o změnách, které ČR čekají v souvislosti s účinností rekodifikace trestního zákona k 1. 1. 2010. Součástí práce je také několik statistických údajů, ze kterých je patrný vývoj problému spočívajícího v porušování práv majitelů ochranných známek v ČR za posledních několik let. Závěr práce se věnuje zhodnocení stávající i budoucí ochrany práv z ochranných známek v ČR.

Abstract:

The following bachelor's thesis on "Enforcement of intellectual property rights in the Czech Republic" deals with current trends in theoretical and practical level of protection of intellectual property rights in the Czech Republic, especially with regard to the protection of trademarks in connection with the production and distribution of counterfeit brands. It builds on the current legal framework for the region, maps the institutional and program support, and also describes how the goods infringing the rights of owners of trademarks arrive in the Czech Republic and how they are distributed. This work also thoroughly evaluates the private, criminal and administrative level, or processes that aim to protect owners rights in the legal sectors. It also shortly refers to changes that the Czech Republic awaits in connection with the new Criminal Code which is to take effect on 1. 1. 2010. The work also includes some statistical data, which makes the development of the problem's violations of the rights of owners of trademarks in the Czech Republic over the past few years evident. Conclusion of the thesis focuses on assessment of current and future protection of trademarks in the Czech Republic.
