Abstract:

Bakalářská práce nese název „Žaloba a její náležitosti“. Hlavním cílem bylo analyzovat žalobu z pohledu jejího obsahu a uplatnění v civilním procesu. Úvod se věnuje historickému vývoji žaloby a její transformaci do současné podoby. Následuje osvětlení samotného pojmu žaloba, účastníků řízení, předmětu žaloby a dalších prvků, které mají vliv na průběh řízení. V další části podrobně popisuji způsoby podání žaloby a právní účinky spojené s tímto procesním úkonem. Pokračuji důležitou kapitolou o tom, jaké náležitosti musí žaloba obsahovat a navazuji rozdělením civilních žalob a petitů. Práci zakončuji polemikou na problematické téma, kterým je právo projednání věci ve stanovené lhůtě a bez zbytečných průtahů. Tím dávám najevo svůj názor, že rychlost soudu ovlivňují účastníci řízení, předložené důkazy atd. Dle mého názoru proto nelze za průtahy řízení vinit pouze soudy.

Abstract:

The title of this bachelor thesis is “Action and its requirements”. The main objective was to analyze the prosecution, in terms of its content and use in a civil trial. The introduction deals with the historical development of the prosecution and its transformation into its present form. Followed by the definition of the prosecution, the parties, the subject and other elements that have an impact on the proceedings. The next section discusses ways of taking legal action and associated the procedural steps. Continuing with an important chapter about the formalities, discussion of the actions, and division of the civil actions and prayers. The work ended with controversy, about the right to hear a case within a specified period of time and without undue delay. Then makes its view clear about the speed of the court, affects on the parties and the evidence etc. Therefore in my opinion, the prosecution should not be blamed for the delay in the proceedings by the courts.
