Abstract:

Bakalářská práce se zabývá způsoby a důvody užití přirovnání úřadů k Zámku od Franze Kafky v judikatuře. Cílem bakalářské práce je dohledat soudní rozhodnutí, která v odůvodnění obsahují odkaz na uvedené literární dílo a následně zanalyzovat formu, vysvětlit podstatu použitého přirovnání, kriticky zhodnotit vhodnost užití přirovnání vzhledem ke kontextu soudem řešeného sporu a posoudit, zda užití daného přirovnání v odůvodnění zvýšilo přesvědčivost soudního rozhodnutí. V případě nalezených problémů jsou navrhnuta řešení.

Abstract:

The bachelor thesis deals with the ways and reasons for using reference to The Castle by Franz Kafka in description of the state authorities in the case law. The aim of the bachelor thesis is to find court decisions using the reference to the literary work in the justification of a decision. The form of the reference is analysed and the essence of the analogy used is explained. The thesis also critically evaluates whether the reference has been used appropriately with regard to the context of the court dispute. Finally, it evaluates whether the reference used in the justification increased the conclusiveness of the court decision. Solutions are suggested in cases where problems were identified.
