Legal Aspecs of Permission to Use Constructions of Energy Facilities

Abstract:

Téma své semestrální práce jsem zvolil zejména z důvodu, že jsem zaměstnán na Energetickém regulačním úřadu na úseku licencí, kde se denně zabývám žádostmi o povolení podnikat v energetických odvětvích dle zákona č. 458/2000 Sb., o podmínkách podnikání a o výkonu státní správy v energetických odvětvích a o změně některých zákonů (energetický zákon), ve znění pozdějších předpisů. V rámci těchto správních řízení se obvykle setkávám i s problematikou staveb energetických zařízení a jejich užívání, která odráží v technických předpokladech pro udělení licence, jejichž prokazování je upraveno vyhláškou č. 426/2005 Sb., o podrobnostech udělování licencí pro podnikání v energetických odvětvích. Zvláště znění § 9 zmíněné vyhlášky je důležité pro výkon mého povolání, který úzce souvisí s tématem zvolené práce. V práci bych se chtěl zaměřit na specifika nejčastějších případů povolení užívání staveb následně sloužících k energetickým účelům (vodní elektrárny, fotovoltaické elektrárny, kotelny, teplárny, vedení vysokého napětí, plynovody). Právo zřizování a zejména užívání staveb těchto zařízení je úzce provázáno se zákonem č. 183/2006 Sb., o územním plánování a stavebním řádu (stavební zákon). Dotknout bych se chtěl také některých nejasností ve stavebním zákoně a toho, že stavební úřady nepostupují v obdobných případech vždy shodně a na téměř identické stavby volí často aplikují jiná ustanovení právních předpisů.

Abstract:

The main topics of the baccalaureate thesis are the institutes giving permission of usage of the energy constructions. I chose this topic because I have to deal daily with the applications for permissions to run a business in the energy sector according to the Act No 458/2000 about the business conditions, the state administration achievements in the energy sectors and about the change of several acts (The Energy Act) subsequently amended. In my work I focused on the specifics of the most frequent cases of the permission of usage of the constructions used for energy purposes (hydraulic power stations, photo voltaic power stations, boiler - rooms, heat stations, high-voltage transmission lines and warm - water pipelines). These constructions create a common part of our surroundings and, unless a problem occurs, we do not notice them properly. I also showed in my work the disunity of the decision - making process of the state administration, when many building authorities choose different ways of agreeing the usage. The permission to use these constructions is closely connected to the Act No 183/2006, act about landscape planning and building regulations (The Building Act), subsequently amended. I therefore structured the baccalaureate thesis appropriately, starting with the history of the building law, next mentioning the structure of the building act and, finally, dealing with the usage permission institutes of the energy constructions in the most extensive chapter. The institutes are mentioned in order according to the complexity of the agreed construction, from the least complex to the most complex constructions. As I introduced the possibilities of permission of the usage of energy constructions, I also showed the particular decisions of the building authorities, which were applied for these situations. I also listed the cases, in which doubts were possible to occur, whether the constructions could be used legally or not. Finally, I introduced an appeal for legislators either not to change the law at all or to make it simpler with each new amendment, not more difficult, as unfortunately often happens nowadays.
