Tenancy by the entirety (community property by entirety)

Abstract:

The main content of the bachelor work is the issue showing the community property as well as the characteristic of historic progress of marriage and communio bonorum of married couple. The main purpose is to zoom in this issue, to assign her´s advantages as well as disadvantages, which unfortunately dominates in regard to momental way of life and possibilities. Especially in marriage, which is for this issue the most important thing, whereas the rise of community property is directly dependent with the marriage celebration. The other purpose is to show the actual law adaptation of the institute of the community property , which is already insufficient in present times and at the same time to point out the suggested legislative intention of the civil law, which could be a huge proposition for solving out a great amount of problems in this institute of community property.

Abstract:

Hlavným obsahom bakalárskej práce je problematika bezpodielového spoluvlastníctva manželov ako aj charakteristika historického vývoja manželstva a majetkového spoločenstva manželov. Cieľom práce je priblížiť danú problematiku, poukázať na jej výhody ako aj nevýhody, ktorých je bohužiaľ trochu viac vzhľadom na momentálny životný štýl a možnosti. Hlavne v manželskom živote, ktorý je pre danú problematiku tým najdôležitejším, nakoľko vznik bezpodielového spoluvlastníctva manželov je priamo závislý od vzniku manželstva. Ďalším cieľom je poukázať na aktuálna právnu úpravu inštitútu bezpodielového spoluvlastníctva manželov, ktorá je už pre toto obdobie nepostačujúca a zároveň dať do povedomia navrhovaný legislatívny zámer Občianskeho zákonníka, ktorý môže byť veľkým prínosom pre vyriešenie mnohých problémov v inštitúte bezpodielového spoluvlastníctva manželov.
