Legal aspects of employing foreigners in the Czech Republic

Abstract:

Tato rigorózní práce se zabývá právními aspekty zaměstnávání cizinců na území České republiky. Těmito aspekty jsou zejména různá pracovní povolení zahraničních zaměstnanců, jejich povolení k pobytu na území České republiky, nároky na nediskriminační zacházení ze strany zaměstnavatelů i orgánů státní moci a možnosti ochrany jejich práv. Srovnává rozdíly mezi občany České republiky, zemí EU, EHP a Švýcarska a tzv. třetích zemí při jejich možnostech usadit se na území České republiky a vykonávat zde své povolání. Výchozím bodem je analýza této problematiky z pohledu českého vnitrostátního práva, práva EU a mezinárodních smluv. Tato východiska jsou zasazena do kontextu základních zásad a principů ovládajících řízení, týkajících se především získání potřebných povolení k pobytu na území České republiky či získání povolení k výkonu povolání. Rigorózní práce se zabývá současnou právní úpravou této problematiky se zohledněním možného budoucího vývoje, obzvláště v oblasti regulace migrace pracovní síly, ochrany a prosazování práv zaměstnanců ze zahraničí.

Abstract:

This rigorous thesis deals with the legal aspects of employing foreigners in the Czech Republic. These aspects are, in particular, various work permits of foreign employees, their residence permits in the Czech Republic, claims for non-discriminatory treatment by employers and state authorities and the possibility of protecting their rights. It compares the differences between citizens of the Czech Republic, EU countries, the EEA and Switzerland and the so-called third countries in their ability to settle in the Czech Republic and practice their profession there. The starting point is an analysis of this issue from the perspective of Czech national law, EU law and international treaties. These starting points are set in the context of the basic principles and principles governing the proceedings, concerning in particular the acquisition of the necessary residence permits in the Czech Republic or the acquisition of a profession. The rigorous thesis deals with the current legal regulation of this issue, taking into account possible future developments, especially in the field of regulation of labor migration, protection and enforcement of employees' rights from abroad.
