Work Obstacles on the Side of Employee

Abstract:

Bakalářskou prací analyzuji současnou právní úpravu překážek v práci na straně zaměstnance jako důležité součásti pracovněprávních vztahů,v nichž plní funkci ochrany zájmů zaměstnance i zaměstnavatele. Po krátké charakteristice překážek a ohlédnutí do historie sociálního ochranného zákonodárství uvádím související platné právní předpisy, ze kterých následně čerpám při strukturovaném výčtu jednotlivých druhů překážek v práci na straně zaměstnance ve druhé kapitole své práce. Variabilita možných situací, které lidský faktor přináší do pracovního procesu, se projevuje zejména při uplatňování a prokazování tohoto institutu v souvislosti s poskytováním finančních náhrad a je obsahem třetí kapitoly, ve které jsem věnovala prostor i legislativnímu procesu. Navazuji aktuální judikaturou a odbornými právními názory, které mi pomohly v závěru práce vyslovit možnou odpověď na příčiny chybné aplikace právních norem při uplatňování překážek v práci na straně zaměstnance.

Abstract:

In this bachelor thesis I have analysed the current legislation related to work obstacles on the side of employee, as it is an important part of labour-law relations and aims to protect the interests of employees as well as employers. After a short description of the obstacles and retrospective insight into the history of social protective legislation, related current regulations are presented and on this framework of regulations I based the overview of work obstacles on the side of employee in the second chapter of my thesis. The third chapter, in addition to the variability of potential situations that a human factor brings to the work process and it shows especially when applying and proving this institute in connection with the provision of financial compensation, also deals with the lawmaking process. Then I follow the current judicature and expert opinions within the legal framework, which allowed me to find the possible solution to the causes of incorrect application of the legal regulations when putting the work obstacles on the side of employee into practice described at the end of my bachelor thesis.
