Abstract:
Cílem této diplomové práce je v prvé řadě vymezení pojmu vadného plnění a jeho odpovědnostní povahy, uvedení jeho právních následků a jeho systematické zařazení. Obsahem této práce je dále i historický vývoj tohoto institutu se zvýšeným důrazem na právní úpravu obsaženou v občanském zákoníku z r. 1964 a analýza tohoto pojmu v kontextu nového občanského zákoníku včetně srovnání těchto dvou klíčových …more
Abstract:
The aim of this thesis is firstly the definition of the concept of defective performance, its liability characteristics, consequences and systematic classification. Further the thesis deals with historical development of this concept. Stress is put on its regulation in the civil code adopted in 1964 and the new regulation effective since 1 January 2014, including its comparison.
