Abstract:

Téma této bakalářské práce zní Trestná součinnost a právní nástroje proti organizované kriminalitě. Práce je zpracovávána v období, kdy je po dlouhé řadě novelizací v legislativním procesu vládní návrh nového trestní zákona. Cílem práce je vymezení pojmů trestná součinnost a organizovaná kriminalita. Dále jsou popsány jednotlivé obecné a zvláštní formy trestné součinnosti skutečné a obecné a zvláštní formy trestné součinnosti zdánlivé. Další část textu je věnována právním nástrojům proti organizované kriminalitě. Jsou rozebrány znaky skutkové podstaty trestného činu účast na zločinném spolčení, jakož i samotná definice zločinného spolčení. Jedna z kapitol je věnována různým přístupům právních systémů jednotlivých států k boji s organizovaným zločinem. Jedná se o pohled na legislativu USA, Německa a Rakouska. Účinnost právních prostředků při potírání organizovaného zločinu bude nepochybně nadále diskutována a budou hledány cesty k jejímu dalšímu zvýšení. Je zřejmé, že účinnost nástrojů proti organizovanému zločinu se odvíjí od šíře pravomocí státních orgánů, a to s dosahem do oblasti ochrany lidských práv a soukromí. V zájmu všeobecné bezpečnosti je potřebné zajistit takový stav, kdy tyto pravomoci jsou pro splnění svého účelu dostatečné a přiměřené. Při pohledu na ustanovení návrhu nového trestní zákona týkající se trestné součinnosti lze konstatovat, že navrhovatel se nově vypořádává se znakem spolupachatelství, a to „spáchání činu společným jednáním“, tak, že popis jednání při tzv. dělání zdi či volavky uvádí v demonstrativním výčtu upřesňující pomoc s tím účelem, aby toto jednání bylo dále považováno v souladu s právní naukou za formu pomoci, nikoli za spolupachatelství. Dále návrh obsahuje zánik trestní odpovědnosti účastníka. Co se týče úpravy institutu zločinného spolčení je v důvodové zprávě k novému trestnímu zákonu konstatováno, že je tento pojem nahrazen pojmem „organizovaná zločinecká skupina“, v souladu s mezinárodními smlouvami. Základní skutková podstata trestného činu účasti na organizované zločinecké skupině a definice organizované zločinecké skupiny jsou beze změny.

Abstract:

The topic of this bachelor thesis is the Criminal Cooperation and Legal Instruments Against Organized Crime. The thesis is being drawn up in the period when, after a long number of amendments, a new government bill of a new criminal code is under legislative process. The aim of the thesis is specification of the terms of criminal cooperation and organized crime. There are also described individual general and special forms of actual criminal cooperation and special forms of apparent criminal cooperation. The next part of the text deals with the legal instruments against the organized crime. The elements of the body of the “participation in criminal conspiracy” crime as well as the definition of the criminal conspiracy itself are analysed. One of the chapters deals with different attitudes of legal systems of individual countries to combating the organized crime. It is the inside into the legislation of the U.S.A., Germany and Austria. The efficiency of legal means in combating the organized crime will undoubtedly continue to be discussed, and the ways of its further increase will be sought for. It is obvious that the efficiency of legal means against the organized crime depends on the scope of powers of the state authorities, penetrating into the field of protection of human rights and privacy. In the interest of general security, it is necessary to ensure the situation when such powers are sufficient and appropriate to fulfil their purpose. Looking at the provisions of the bill of the new criminal code concerning the criminal cooperation, we may state that the submitter of the bill newly tackles the element of complicity, i.e. “committing a crime by common action” through stating the description of acting during so-called “keeping watch” or acting as an “agent provocateur” in a demonstrative list with specification of assistance for the purpose of considering such acting still a form of assistance, not a complicity, in accordance with the legal science. The bill also covers extinction of legal liability of a participant. As far as the regulation of the criminal conspiracy is concerned, there is a statement in the explanatory report saying that the term has been replaced by the “organized criminal group“ term, in accordance with international agreements. The basic body of the crime of participation in an organized criminal group and the organized criminal group definition remain unchanged.
