Racial motiveted extremism

Abstract:

Zhodnocení tématu V první ad si musíme uvdomovat, že otevení se demokracii pináší množství problém, na které nebyla souasná obanská spolenost moráln ani materiáln pipravena. Nadasové fenomény jako jsou migrace, prostituce, kriminalita, alkoholismus byly násobeny ve svých projevech. Snaha osvobodit se mže být provázena odmítáním autority spolenosti. Problematika odporu vi této spolenosti se mže projevovat nap. ve form rzných druh extremismu, squatterství, v krizi rodiny, násilí v rodin, tedy zkrátka v rozpadu vžitých morálních princip. S projevy extremismu, rasové nesnášenlivosti a projevy xenofobie se více i mén potýkají všechny demokratické státy. Ve stedoevropském geopolitickém prostoru byl v posledních letech pítomen pedevším pravicový extremismus. Situace v eské republice se v obecnosti nevymyká tomuto trendu. Zastoupení základních extremistických smr nedoznalo v posledních letech zásadních zmn. Na eské extremistické scén byly zastoupeny jak smry pravicov extremistické, tak levicov extremistické. V posledních dvou letech, stejn jako v pedchozích letech, docházelo na území eské republiky k nejzávažnjší trestné innosti v souvislosti s rasovou a národnostní nesnášenlivostí. Trestná innost s rasovým i národnostním podtextem byla pevážn páchána píznivci hnutí skinheads a i nadále smovala proti píslušníkm romské komunity. Policie R a další orgány inné v trestním ízení pokraovaly v aktivitách zamených na stíhání trestné innosti páchané prostednictvím tiskovin, symbolik a zástupných znak. Ve spojitosti s tím se policii v letech 1998 2000 podailo ásten rozkrýt celorepublikovou organizaci Blood&Honour DB a paralyzovat její innost. eská extremistická scéna a samozejm i hnutí skinheads dosáhly oproti pedcházejícímu období kvalitativn vyššího stupn, zapojily se do mezinárodních struktur, jejich projevy nabyly na razanci. Pro celé pravicov extremistické spektrum vetn hnutí skinheads byla v posledních letech píznaná práv aktivizace, provázená snahou nkterých subjekt petransformovat se ve standardní politické strany. Dobrá organizovanost a mezinárodní kontakty tomu jen napomáhají. K tomu ješt pipotme možnosti oslovení i relativn širokého spektra potenciálních voli, kteí za ráznými hesly a jednoduchým ešením aktuálních otázek stávající spolenosti nevidí krajn pravicové pozadí. Získáním by jen uritého, i když ne rozhodujícího, podílu na moci by mohlo mít nepopsatelné následky, které tkví pedevším v legalizaci výrok a myšlenek hnutí a tímto smrem pak v daleko vtší míe a možnostech ovlivovat myšlení oban naší republiky ve prospch hnutí a tím získávat stále vtší podporu pro své cíle. Za stávající situace, která klade na orgány inné v trestním ízení stále vtší nároky, zejména pak i z hlediska mezinárodní spolupráce je zapotebí i nadále klást draz jak na innost specializované skupiny pro boj s extremismem psobící v rámci Policejního prezídia, tak specialist na krajské a okresní úrovni. Spolupráce s Bezpenostní informaní službou, Vojenským obranným zpravodajstvím a orgány innými v trestním ízení zstává nadále základem pro úspšný boj s extremistickou a rasov motivovanou kriminalitou. Rasov motivovaná kriminalita nedosahuje velkého procentuálního ísla ve srovnání s jinou trestnou inností páchanou na území R. Uritým problémem orgán inných v trestním ízení v boji s jakoukoli formou extremismu, však nadále zstává nepíliš dsledné uplatování všech do úvahy picházejících ustanovení trestní zákona a jisté problémy s dokazováním a to zejména rasov motivované trestné innosti. Dle mého názoru je jedním z hlavních pedpoklad úspšné eliminace výše uvedeného fenoménu, vedle odhodlaného prosazování práva, všestranná prevence za úasti všech ostat

ních resort, ale i nevládních organizací. Cílem musí být zmna celkového klimatu v eské spolenosti, který do znané míry spoluvytváí, ale i limituje manévrovací prostor a možnosti hnutí skinheads a potažmo i celého spektra extremistického hnutí. Jak problematiku rasov motivovaného extremismu, tak i jiných projev extremismu a xenofobie musíme ešit jinde než v pouliních bitkách, politických kuloárech a kanceláích tajných služeb. Mla by se pedevším ešit již na školách a v rodinách samotných. Vždy je totiž lepší uritému jevu pedcházet, než-li jej pozdji složit ešit. Nutno ovšem dodat, že jev spojený s rasov motivovaným extremismem už u nás nastal, a proto by mlo být naším prvoadým úkolem jej alespo co nejvíce minimalizovat a neumožovat mu další zhoubné se šíení naší spoleností a to tím, že na tento závažný kriminální a sociální problém budeme neustále poukazovat a budeme i vysvtlovat základní rozdíly a principy fungování demokratické spolenosti i s jejími nedostatky v porovnání s principy a programy extremistických hnutí.

Abstract:

Racial motivated extremism The aim of my work was to try to address the question of racially motivated extremism, or we can use the expression racially motivated criminal activity, and the conjunction with criminal law. The theme in question is extensive and I can say that this problem can be called inexhaustible and offers many questions that could be the subject of a separate work. Racially motivated extremism can be looked at from many angles, by which I mean that it is possible to look at this issue from the viewpoint of sociology, criminology, criminal justice, or other fields. As an introduction, I tried to put forward its direction, briefly characterize the extremist scene in the Czech Republic, and also demarcate the basic concept, which obviously serves for better orientation in the subject of the article. Extremism is a very frequently used concept in society, which people use to denote activity that they believe cannot possibly be tolerated, especially if this activity is connected with people they consider adversaries. In the second part of my bachelor work, I have concerned myself with the theme that provided the title for the work as a whole: racially motivated extremism. I have summarised here its characteristics, forms, the methods of committing racially motivated crimes, and the types of attack on protected interests. There is also a brief characterisation of the perpetrators of racially motivated crimes and the object of attack. In connection with criminal law, especially here to material criminal law, I have aimed at a basic overview of criminal activities that are committed in connection with racially motivated crime. Within the concept of crime with an extremist subtext can be understood those types of criminal activities about which there is reason to think that they were motivated or influenced by an extremist attitude. By this I mean that it is behaviour that completes the elements of the factual basis of the crime or offence and its motive is hatred arising from the victim's race, nationality, religion, class, or membership in any other social groups, whereas crimes that fall into this category include crimes against symbols or representatives of the existing social system, if motivated by hatred of it. Criminal offences with a racial subtext are very often committed due to an extreme situation, and in many cases it is objectively debatable whether the attack is motivated by actual hatred of a group and not simply a display of bad interpersonal relationships. In the third part of my work, I have tried to connect the subject in question with the process of criminal justice. Topics mentioned here concern laws of association and assembly and a number of examples of racial attacks are provided. I also addressed the question of revealing, investigating, and proving racially motivated criminal offences. In the conclusion, I summarized the possibilities of cooperation in suppressing racially motivated extremism, cooperation with state authorities, local government, and also nongovernmental organisations; in this part I embarked on a small aside into this problem. Extremism is oriented against democratic society in particular, at the same time, of course, it can be a product of it. The problem of extremism, which comes to light in the Czech Republic primarily in public displays of racism and xenophobia, is not a phenomenon exclusive to the Czech Republic. Mature democratic states also deal with this dangerous problem, and it is therefore necessary to look at it in two interconnected levels, that is, internal Czech and international, to appreciate its pan-European context. The conditions we know as globalisation have naturally not bypassed extremist groups, who work together internationally with the help of modern means of communication, and it is necessary to devote ever greater attention to displays of extremism.
