Inheritance agreement

Abstract:

Práce se zaobírá institutem dědické smlouvy jako pořízením pro případ smrti, které je do českého právního řádu zaváděno znovu po více než šedesáti letech. Náležitý ohled je věnován švýcarskému právnímu prostředí, ze kterého je do nového občanského zákoníku úprava dědické smlouvy přejata. Předestřena je možná typologie dědických smluv a následně práce sleduje náležitosti dědické smlouvy jako právního jednání i následky, které vyvolává. Práce poukazuje zejména na aleatorní charakter vztahu smluvního dědice k pozůstalosti a z toho plynoucích následků. Pozornost je věnována též některým zvláštním institutům závazkového práva, u kterých autor následně dovozuje jejich nepoužitelnost na dědickou smlouvu.

Abstract:

The paper deals with the institution of the inheritance agreement as a provision for the event of death, which is once again being introduced into the Czech legal system after more than sixty years. Due regard is devoted to the Swiss legal environment, from which the regulations on the inheritance agreement are being adopted into the new Civil Code. A possible typology of inheritance agreements is presented, and subsequently the paper studies the required content of the inheritance agreement as a legal action, as well as the consequences that it brings about. The thesis points out primarily the aleatory nature of the relationship of a contractual heir in regard to the inheritance and the consequences arising from that. Attention is also paid to some special institutions of obligation law, in regard to which the author subsequently infers their inapplicability in regard to the inheritance agreement.
