Theories of social contract in view from feminism

Abstract:

Tato práce pojednává o Teoriích společenské smlouvy z perspektivy feminismu. Hlavním bodem je představit smluvní teorie pohledem tří klasických autorů: Thomase Hobbes, Jeana-Jasquesa Rousseaua a Johna Locka a přinést k nim feministickou reflexi. Tito tři klasičtí teoretikové se zabývají vznikem státu a jeho funkcemi a přimárně tak rozdělují lidskou historii to dvou period, a to konkrétně před vznikem státu a po něm. Feministky později kritizují přístup těchto autorů primárně proto, že se domnívají, že některé body v pomyslné smlouvě značně přesahují do soukromí ženy a tím jí značně znevýhodňují. Princip pomyslné rovnosti před zákonem, tedy smlouva plošně negarantuje, ačkoli by měla. Tato práce si klade za cíl popsat, jak klasické smluvní teorie, tak i přinést feministickou reflexi, proto jsou rozebírány i pojmy jako je patriarchát nebo gender.

Abstract:

This thesis is about the Theory of the Social Contract from the Perspective of Feminism. The main point is to introduce the Theory from the viewpoint of three classical authors: Thomas Hobbes, Jean-Jacques Rousseau and John Locke and bring critical feminist reflection. These three contract theorists divided the state of human history into two periods, which we call The State of Nature and the period after the contract, Civil Society (apart from Rousseau and his concept of wild man). Feminism in general criticized the attitude of these authors, because they pointing out some points in the contract by classical theorists which lay ground for disadvantages of women, especially because they intruded into their privacy and favored men in general. The concept of patriarchy and the topic of gender will be mentioned as well.
