Abstract:

Anotace: Tato práce se zabývá pojistnou smlouvou. Jaké okolnosti v historii lidstva vedly ke vzniku pojištění jako takového a jak se pojištění postupem doby a větší vzdělanosti lidí dále vyvíjelo. Objasňuje co je to vlastně pojem pojištění a pojistné riziko. Popisuje vývoj různých druhů pojištění a pojistných smluv od prvních dochovaných zmínek civilizovaných kultur ve starověku, přes rozvoj námořní dopravy a tím související potřeby pojištění ve středověku až po vývoj pojišťoven v českých zemích do současnosti. Následně práce specifikuje podmínky a současnou legislativu EU a České republiky, která upravuje pojišťovnictví a pojistnou smlouvu. Stručně nás práce seznámí s nejčastějšími druhy pojištění na našem pojistném trhu. Blíže pak rozvádí náležitosti pojistné smlouvy, kdy a za jakých podmínek vzniká a zaniká pojistný vztah. V návaznosti na to, že od 1.1.2014 vešel v platnost v ČR nový Občanský zákoník, který má zásadní dopady na pojistný vztah i pojistnou smlouvu, se budu dále podrobně zabývat porovnáním rozdílů mezi původní a současnou legislativou s dopadem na pojistnou smlouvu. Závěrem této práce analyzuji a porovnávám pojistné smlouvy podnikatelských rizik tří vybraných pojišťoven, kde jsem se zaměřila na obsah i formu jednotlivých smluv.

Abstract:

Annotation This work focuses on an insurance policy what conditions in human history led to the origin of the insurance as such and how it gradually developed over time and due to better human knowledge. It clarifies what the terms insurance and insurance premium mean. It depicts the development of various types of insurance and insurance policies from the first well preserved records of civilized ancient cultures, through the growth of sea transport and relating needs for insurance in the medieval era, to the development of Czech insurance companies up to the present. Subsequently, the Bachelor thesis specifies conditions and present legislation of EU and the Czech Republic that adjust insurance and the insurance policy. The work briefly deals with the most common types of insurance at the Czech market and it elaborates terms of an insurance policy in detail (when and on what conditions an insurance relation emerges and ends). In connection with a new civil code (which came into force on 1st January 2014 and it has a fundamental impact on an insurance relation and an insurance policy), I will deal with a comparison of the differences between the previous and present legislation with its effect on an insurance policy in more detail. In the final part of my thesis I will analyze and compare business risk insurance policies of three selected insurance companies, where I concentrated on the content and the form of the individual insurance policies.
