Abstract:

Tato bakalářská práce se zabývá právním institutem věcných břemen a jejich jak historické, tak aktuální úpravě v českém právu. Věcná břemena jsou věcná práva k věci cizí, dělena na služebnosti a reálná břemena, přičemž vlastník služebné věci, ať už movité či nemovité, omezovaný služebností je povinen něco strpět, něčeho se zdržet, nebo něco konat. První kapitola se zabývá historickým vývojem věcných břemen a vůbec vymezením tohoto právního pojmu až do současnosti. Aktuální právní úpravě v novém občanském zákoníku, Zákon č. 89/2012 Sb., se podrobněji věnuje kapitola druhá, vymezující věcná břemena v mnohem rozšířenější podobě s užitím jak zcela nových institutů věcných břemen, tak s převzetím mnoha zastaralých a již nepoužívaných právních úprav, spolu se zamyšlením, co vedlo autory NOZ k převzetí obsoletních právních institutů a dále způsoby vzniku věcných břemen, evidence, omezení či zrušení a zániku. Třetí kapitola se zabývá mírou omezení vlastnického práva v případě věcných břemen a možnými způsoby jejich ochrany, ať už ze strany oprávněného ze služebnosti, nebo vlastníka věci služebné. Poslední kapitola se pak poukazuje na příklady zřizování různých věcných břemen a je doplněna o archivní, dobové, listiny a materiály.

Abstract:

This thesis deals with the legal institute easements and both historical and current treatment in the Czech law. Easements are rights in rem to another person’s property, divided into servitudes and real burdens, whereby the owner of the serving things, whether movable or immovable, strapped by the servitude is obliged to tolerate something, to refrain from, or do something. The first chapter deals with the historical development of easements and even the definition of this legal concept until the present. Current legislation in the new Civil Code, Law no. 89/2012 Coll., further discussed in the second chapter, defining the easements in the form of a more widespread use as a completely new institutes of easements and the takeover of a number of obsolete and superseded legislation, together with the reflection what led the authors of the new Civil Code to assume the obsolete legal institutions and further also discusses ways of creation of easements, registration, reduction or termination and annulment. The third chapter deals with the degree of the limitation of property rights in the case of easements and possible ways of their protection, either by the beneficiary of the service, or by the owner of the burdened property. The last chapter highlights examples of setting up and use of various easements and is complemented by archival, historical, documents and materials.
