Presidential Powers

Abstract:

Tato diplomová práce uvádí čtenáře do problematiky pravomocí prezidenta. Práci zahajujeme historickým úvodem. Následuje objasnění postavení prezidenta v rámci ústavního systému a vysvětlení pojmů kontrasignace a odpovědnosti prezidenta. Poté se věnujeme popisu jednotlivých pravomocí, v rámci kterého jsme uvedli teoretická východiska, různé názory odborníků a rovněž naše názory. V naší práci uvádíme několik komparací české právní úpravy s cizími. V textu této práce často demonstrujeme pravomoci prezidenta na skutečných případech z nedávné doby. V závěrečné části práce zodpovídáme otázky, zda může prezident odmítnout jmenování do určité funkce a zda je toto rozhodnutí soudně přezkoumatelné.

Abstract:

This thesis puts reader into the issue of presidential powers. We begin the thesis with historical introduction. It is followed by clarification of the position of the president within the constitutional system and explanation of countersignature and liability. Then we give the description of individual powers and within the description we state theoretical basis, different experts‘ opionions and also our own opinions. In our thesis we state several comparisons of czech legislation with foreign legislations. In the text of this thesis we often demonstrate presidential powers on real recent cases. In final part of the thesis we answer questions, if president is allowed to refuse appointment to certain position and if is such act judicially reviewable.
