Hearing of a Person under the Influence of Narcotic – Psychotropic Substances, Evidential Value

Abstract:

Předkládaná diplomová práce s věnuje specifikům výslechu osoby pod vlivem omamných a psychotropních látek (dále OPL) a důkazní hodnotě provedených úkonů. V první řadě jsme si vymezili, co to vlastně OPL je, jak se dělí a jaké můžou být stavy po jejich užití. Dále jsme si vymezili, jaké jsou vlastně důkazní prostředky, včetně jejich použití v jednotlivých fázích trestního řízení. Z této množiny jsme se pak dále zabývali výpovědí svědka a výpovědí obviněného, jakožto úkonů procesně použitelných. Závěrem jsme si rozebrali specifika jednotlivých úkonů, včetně taktiky při jejich provádění, a to nejen z hlediska kriminalistiky, ale také psychologie. Zde jsme věnovali několik stran práce i specifikům výslechu osob pod vlivem OPL, včetně možných úskalí při provádění těchto důkazů.

Abstract:

The presented diploma thesis deals with the specifics of interrogation of a person under the influence of narcotic and psychotropic substances (hereafter the OPL) and the probative value of performed acts. First of all, we defined what the OPL is, how it is divided and what the states can be after their use. We also defined the criminal evidence, including its use in the various stages of criminal proceedings. From this set, we then dealt with the testimony of the witness and the testimony of the accused as procedurally applicable. Finally, we analysed the specifics of individual acts, including tactics in their implementation, not only in terms of criminology, but also psychology. Here we devoted several pages of work to the specifics of the questioning of persons under the influence of the OPL, including possible pitfalls in the implementation of this evidence.
