Abstract:

Anotace V této práci jsem se zabýval tématem Okolnosti vylučující protiprávnost, pod kterými shrnuje teorie trestního práva některé okolnosti, které způsobují, že čin, který se svými rysy podobá trestnému činu, není nebezpečný pro společnost a není tedy ani trestným činem. Toto téma jsem si vybral v souvislosti s novým trestním zákoníkem od 1.1.2010, který byl stejnou účinností novelizován zákonem č. 306/2009 Sb., kterým se mění zákon č. 40/2009 Sb., trestní zákoník, kde došlo u okolností již upravených v minulém zákoně k drobným změnám, ale současně došlo k jejich rozšíření o svolení poškozeného a přípustné riziko. Samotná práce se skládá z několika částí. V první části jsem se zabýval historickým vývojem na území ČR od novodobých dějin konce 18. století až po trestní zákon č. 140/1961 Sb. ve znění pozdějších změn a doplňků s platností do 31.12.2009. V druhé části jsem vymezil některé pojmy, které souvisejí s okolnostmi vylučujícími protiprávnost. Ve třetí až sedmé části jsem se věnoval jednotlivým okolnostem uvedených v platné právní úpravě, a to krajní nouzi, nutné obraně, svolení poškozeného, přípustného rizika a oprávněného použití zbraně, které jsem se snažil v této práci popsat. Současně jsem provedl jejich porovnání navzájem, ale i ve vztahu k předchozí právní úpravě, a ve stručnosti jsem uvedl i případy z praxe. Vzhledem k obsáhlému rozsahu institutu okolností vylučujících protiprávnost jakým bezesporu jsou, nebylo mým úmyslem je rozebírat do hloubky, ale mým cílem byl jejich popis v ucelené formě, které by měl porozumět i běžný občan. Nová právní úprava tak umožňuje občanům v širším rozsahu, účinněji vystupovat na ochranu zájmů svých vlastních, ale i ostatních občanů v naší společnosti, což napomáhá k upevnění práva a morálky.

Abstract:

Annotation I have engaged in the topic Circumstances excluding the ilegality in my work. The theory of criminal law summarizes some circumstances which cause that the act whose features are similar to the criminal act is not dangerous for the society and that´s why it is not the criminal act. I have choosen this topic in context of new criminal code since 1.1.2010. This criminal code was amended with the same efficiency by the law number 306/2009 (Colection of Law) and that´s why the law number 40/2009 (Colection of law), criminal code is changed. There were little changes in circumstances which have been revised in last law. But at the same time these circumstances were extended of sufferer´s consent and admissible risk. There are several parts in my work. In the first part I have engaded in the historical evolution in the area of the Czech Republic from modern history of the end of 18th century till the criminal law number 140/1961 (Collection of Law) in a word of later changes and supplements with effect till 31.12.2009. In the second part I have specified some concepts related to circumstances excluding the ilegality. In the third part up to the seventh part I have dedicated to particular circumstances mentioned in the valid law enactment namely exigency, private defence, sufferer´s consent , admissible risk and competent using of weapon. I have tried to describe them and to make their mutual comparsion, but in relation to the previous law enactment. In brief I have mentioned the examples from experience. With regard to the wide range of institute of circumstances excluding the ilegality, which they concededly are, my intetion was not to analyze them deep, but my aim was to make their description in the coherent form that should be comprehensible for ordinary citizen. The new enactment enables citizens to conduct for protection of their own interests but also of the interest of other cicizens more effectivelly. This fact helps to the law and morality maintenance.
