Capacity of Czech Justice in Terms of Rapid Protection of Subjective Rights of the Parties in Civil Procedure

Abstract:

Práce si kladla za cíl zanalyzování stavu domácí justice, pokud se jedná o občanské sporné soudní řízení. Z průběhu křivek v prezentovaných grafech obsažených zobrazujících průběh stavu reprezentativně vybraných soudních agend vyplynuly skutečnosti, jež byly využity v analytické části práce. Současně byly zjišťovány příčiny pohybu jednotlivých křivek. Na základě těchto zjištění se mohl autor vyjádřit kupříkladu k účelnosti zvýšení soudních poplatků či zavedení neúplné apelace. Tyto indukované informace naleznou své uplatnění při případných budoucích změnách příslušných institutů. Statistická část pak gradovala zhodnocením stavu tuzemského sporného řízení v kontextu statistických dat ze Slovenské a Polské republiky. Akceschopnost tuzemské justice byla shledána na úrovni vyšší než v případě Slovenska, avšak současně výrazně nižší než v případě Polska, z čehož plyne přítomnost rezerv ve fungování domácího soudnictví. Z tohoto závěru při predikovaném nárůstu nápadu nových věcí lze vyvodit nutnost změn tuzemské justice stran zvýšení její akceschopnosti. Toto zjištění si autor dovolí označit za věcně nejzávažnější. Především statistická část této práce snad nalezne své využití na Ministerstvu spravedlnosti České republiky, které o ni projevilo zájem z důvodu absence obdobné analýzy z vlastních zdrojů. Druhá, rovněž stěžejní část této práce, se týkala prezentace vybraných procesních institutů s potencí posílení stavu justice. Autor se mohl vyslovit pouze k těm nejzásadnějším procesním institutům, když byl limitován doporučeným maximálním rozsahem práce. Zvolil proto menší důraz na deskripci a zaměřil se na poukázání problematických míst současné právní úpravy a její aplikace, jako například v případě zákazu předbíhání konečného rozhodnutí ve věci výrokem předběžného opatření. Vyslovil se pro maximální možné využití potenciálu současné právní úpravy, když poukázal na obecně nevyužívané metody, které pro svoji aplikaci současně nepotřebují změnu právní úpravy, jako v případě dotazu dle obecného informačního zákona za účelem zamezení průtahů v konkrétním řízení. Konečně pak autor navrhl úvahou de lege ferenda modifikace prezentovaných institutů, pakliže byly shledány jako potřebné – viz kupříkladu návrhy změn rozkazního řízení. V případech, které vyplynuly z mezinárodněprávní komparace, se úvaha de lege ferenda nechala inspirovat zahraniční úpravou. Návrh změn procesních institutů je současně i praktickým počinem druhé stěžejné části práce.

Abstract:

This thesis titled „Capacity of Czech Justice in Terms of Rapid Protection of Subjective Rights of the Parties in Civil Adversarial Procedure“ aims for an analysis of internal statistic data regarding capacity of Czech justice in civil adversarial procedure and for a revelation of relevant reasons. Subsequently it is able to compare this analysed data with relevant analysed Slovak and Polish data as well. All data were taken from official sources – statistic yearbooks of the Ministries of Justice in each country. On the basis of comparison, the state of Czech justice in civil adversarial procedure is revealed. The work discovered many reserves in operation of Czech justice. It appears better than the case of the Slovak Republic, but on the other hand much worse than the case of Republic of Poland. On basis of prospective analysis, these trends were predicted: an increase of new matters to courts and preference for electronic way of communication with court, especially preference of electronic payment order. At the same time, the increase of the court fees appears to be purposeless in relation with the increase of new matters to court. The work formulated general advice to make the work of justice system effective as a necessity of low level of backlogs. Recommended quantity is circa 1/3 of the number of new matters in the relevant year. Main finding of this master's thesis is urgency of parametric changes of Czech justice in the near future. Otherwise justice is going to lose the ability to protect subjective rights of the parties in the civil adversarial procedure. The author has hope for practical use of the statistic chapter on the Ministry of Justice of the Czech Republic, which has no similar comparison available and showed interest in this work. The second major chapter is concerned with Czech procedural civil law. Because of the recommended maximum extent of these thesis, the author was able to deal with only selected legal institutes of procedural civil law, influencing time of proceeding as interlocutory injunction, payment order, tools of protection from disproportionately long time for a court to hold proceeding, constitutional complaint and responsibility of state from disproportionately long time for a court to hold proceeding. This is also the reason why the work does not accent description method instead of discussion about problematic legal fields as in the case of the ban of overtaking final decision in interlocutory injunction. This legal rule is not laid down in legal prescription; it rises up only from the practice of the courts, which is theoretically unconstitutional process. Also content of the ban of overtaking final decision in interlocutory injunction is unclear for the same reason, especially in the content of possible exceptions. Furthermore, the author supported maximum utilization of the contemporary legal system as in the case of use of the Freedom of Information Act for the purpose of prevention of court proceedings taking disproportionately long time which is not commonly used method. Finally the thesis formulates the consideration de lege ferenda – the modifications of mainly payment order and its relevant proceeding. The author suggests e.g. to impose a fee on submission of resistance and to establish qualified resistance with effect on concentration of proceeding. In the cases derived from international legal comparison is consideration de lege ferenda inspired by foreign legal systems. The suggestions of modifications of selected procedural institutes are at the same time the practical act of second major part of this master's thesis.
