Legal aspects of climbing and ski touring in the Czech Republic

Abstract:

Cílem práce je zjistit, jakým způsobem jsou v České republice regulovány aktivity horolezectví a skialpinismu s důrazem na ochranu životního prostředí. V úvodu jsou vymezeny základní právní prameny, obecná východiska a právní instituty související s provozováním horolezectví a skialpinismu. Následují dílčí témata v kontextu ochrany přírody a krajiny, zejména ve zvláště chráněných území. Práce obsahuje též pravidla a praxi udělování souhlasů a výjimek z ochranných režimů, kontrolu činnosti a také odpovědnostní aspekty. Identifikuje také typické negativní vlivy provozovaných aktivit. Závěr práce upozorňuje na slabá místa stávající úpravy a nastiňuje návrhy de lege ferrenda.

Abstract:

The thesis amis to find out the regulation of mountaineering and skialpinism with the emphasis on the protection of the environment in the Czech republic. The first part identifies basic legal sources, general background and legal institutes related with mountaineering and skialpinism. After that follows sectional issues in the context of the protection of the environment, especially in the specially protected areas. The thesis also contains practice of granted consents and exemptions from protection modes, control of the activities and aspects of legal liability. There are also defined typical negative influences of these activities. The end of the thesis shows the weak points of current legislation and outlines thoughts about the law de lege ferrenda.
