Charter of Fundamental Rights of the EU and its application in the Czech Legal System

Abstract:

Tato bakalářská práce se zabývá se zabývá Listinou základních práv Evropské unie a jejím uplatnění v rámci právního řádu České republiky. V úvodních kapitolách je definován obecný význam Listiny EU, její historický vývoj a vznik a struktura, přičemž jednotlivé články jsou podrobně analyzovány z hlediska jejich obsahu a významu. Následně je zkoumáno postavení Listiny EU v rámci unijního práva a její vztah k dalším pramenům práva. Práce se rovněž věnuje Protokolu č. 30, který ovlivňuje aplikaci Listiny EU v určitých státech. Dále se práce zaměřuje na přímý a nepřímý účinek Listiny EU v českém právním řádu a na problematiku jejího prosazování v rozhodovací praxi soudů. Závěrečná část práce rozebírá zásadu přednosti unijního práva a výzvy spojené s její aplikací. Cílem mé bakalářské práce je zhodnotit význam Listiny základních práv EU a identifikovat problémy jejího uplatňování v českém právním systému.

Abstract:

This bachelor's thesis examines the Charter of Fundamental Rights of the European Union and its application within the legal system of the Czech Republic. The initial chapters define the general significance of the Charter, its historical development, origin, and structure, with a detailed analysis of individual articles regarding their content and importance. The thesis then examines the Charter's position within EU law and its relationship with other legal sources. It also focuses on Protocol No. 30, which affects the application of the Charter in certain states. Furthermore, the thesis explores the direct and indirect effects of the Charter in the Czech legal system and the challenges associated with its enforcement in judicial practice. The final part analyzes the principle of the primacy of EU law and the challenges arising from its application. The aim of this thesis is to assess the significance of the Charter of Fundamental Rights of the EU and to identify the issues related to its implementation within the Czech legal system.
