Theft investigation methodology

Abstract:

Bakalářská práce pojednává o metodice vyšetřování nejčastějšího trestného činu, kterým je krádež. Práce je koncepčně členěna na část teoretickou a praktickou. Teoretická část práce se v úvodu věnuje současné právní úpravě krádeže a podrobnému rozboru skutkové podstaty trestného činu krádeže. Kriminalistická charakteristika popisuje krádež včetně obecných komponentů, počínaje způsobem páchání a utajování až po motiv a současně se zabývá typickými charakteristickými stopami. Teoretická část je navíc vhodně doplněna o přehled registrovaných trestných činů krádeží prostých pro období od 2018 do 2022 pro Karlovarský kraj, který poslouží k zodpovězení cíle práce. Praktická část se věnuje metodice vyšetřování od počátečních úkonů až po zapojení veřejnosti do vyšetřování. Závěr práce obsahuje návrhy a doporučení v preventivní oblasti před pácháním trestných činů krádeží. Cílem práce je zjištění, zda došlo ke snížení celkového počtu trestných činů krádeží (prostých) v souvislosti s legislativní změnou v roce 2020, kdy došlo ke změně dolní hranice výše škody rozhodné pro posouzení skutku jako trestného činu za období od roku 2018 do roku 2022 v Karlovarském kraji

Abstract:

The bachelor's thesis discusses the methodology of investigating the most common crime, which is theft. The work is conceptually divided into a theoretical and a practical part. In the beginning, the theoretical part of the work is devoted to the current legal regulation of theft and a detailed analysis of the facts of the crime of theft. The criminalistic characterization describes the theft including the general components, starting from the method of commission and concealment to the motive, and at the same time deals with typical characteristic traces. In addition, the theoretical part is appropriately supplemented with an overview of registered crimes of simple theft for the period from 2018 to 2022 for the Karlovy Vary region, which will serve to answer the objective of the work. Practical studies the methodology of the investigation from the initial actions to the involvement of the public in the investigation. The conclusion of the work includes prevention of theft. The aim of the thesis is to find out whether there has been a reduction in the total number of criminal cases - theft (simple) in connection with the change in the lower limit of the amount of damage decisive for the assessment of the act as a criminal offense for the period from 2018 to 2022 in the Karlovy Vary region.
