Protection of Intellectual Property Businesses

Abstract:

The theme of the bachelor thesis is protection of intellectual property. Whereas sphere of the intellectual property is very comprehensive, the focus of the work is mainly on industrial rights and their protection. The thesis closely defines a lot of terms from the field of law of intellectual property – less from copyright, in wider range from the law of idustrial property. Practical part deals with „traditional speciality guaranteed“ as a part of rights to designation of origin, specifically with Spiš sausages and their tradition as well as current status of their production in slovak business sphere. The first chapter introduces theoretical base – what is the term and the subject of intellectual property. Industrial property rights as well as institutional protection of intellectual property is the main theme of the second chapter. The last – third chapter deals further with a product signed for ,,traditional speciality guaranteed“ and demonstrates practical testing of several kinds of this traditional speciality.

Abstract:

Témou bakalárskej práce je ochrana duševného vlastníctva. Keďže oblasť duševného vlastníctva je veľmi širokospektrálna téma ťažisko práce je hlavne na priemyselných právach a ich ochrane. Práca bližšie a obšírne definuje mnohé pojmy z oblasti práva duševného vlastníctva – v menšom rozsahu autorského práva, vo väčšom rozsahu práva priemyselného vlastníctva. Praktická časť sa venuje „zaručenej tradičnej špecialite“ ako právu na označenie výrobkov, konkrétne Spišským párkom a ich tradícií ale i súčasnému stavu produkcie v slovenskom podnikateľskom prostredí. V prvej kapitole sa uvádza teoretický základ – čo je pojem a predmet duševného vlastníctva a základy autorského práva. Právo priemyselného vlastníctva, taktiež aj inštitucionálna ochrana duševného vlastníctva je témou druhej kapitoly. Posledná – tretia kapitola sa bližšie zaoberá výrobkom nesúcim označenie „tradičná zaručená špecialita“- Spišskými párkami a prináša praktické testovanie niekoľkých druhov tejto tradičnej špeciality.
