Comparison of execution proceeding and bankruptcy of a natural person from the creditor´s point of view

Abstract:

Tématem diplomové práce je srovnání exekučního řízení a oddlužení fyzické osoby z pohledu věřitele. Cílem je popsat proces obou typů řízení, ve kterých je řešeno uspokojení pohledávky věřitele, respektive oprávněného, a představit pro věřitele nejpodstatnější instituty v obou řízeních. Dále je cílem zanalyzovat současnou právní úpravu exekucí a insolvencí a zjistit tím, zda dluh zůstává závazkem, který má být plněn. V tomto ohledu je kladen důraz na shrnutí právní úpravy přijaté v posledních letech, kterému se věnuje první kapitola diplomové práce. Kapitola druhá popisuje základní procesní postup v exekučním řízení. Kapitola třetí shrnuje procesní postup v rámci insolvenčního řízení. Na porovnání procesních postupů v exekučním a insolvenčním řízení, kde je řešen úpadek fyzické osoby oddlužením, se zaměřují kapitoly čtyři až šest. Je řešeno především zahájení řízení, následné uspokojování pohledávky věřitele a skončení řízení. Na závěr je popsán důsledek střetu exekučního a insolvenčního řízení.

Abstract:

The topic of the thesis is to compare enforcement proceedings and debt relief for individuals from the creditor's perspective. The aim is to describe the process of both types of proceedings, in which the satisfaction of the creditor's claim, or legitimate interest, is addressed, and to introduce the most significant institutions for creditors in both proceedings. Furthermore, the goal is to analyze the current legal regulation of executions and insolvencies and thereby determine whether debt remains an obligation to be fulfilled. In this regard, emphasis is placed on summarizing the legal regulations adopted in recent years, which is the focus of the first chapter of the thesis. The second chapter describes the basic procedural steps in insolvency proceedings. The third chapter outlines the procedural steps within insolvency proceedings. Chapters four to six focus on comparing procedural steps in enforcement and insolvency proceedings, where the insolvency of an individual is resolved through debt relief. It primarily deals with the initiation of proceedings, subsequent satisfaction of the creditor's claim, and the conclusion of proceedings. Finally, the consequence of the collision between enforcement and insolvency proceedings is described.
