Abstract:
Tato práce se zabývá problematikou odpovědnosti veřejné moci v souvislosti s nesprávným úředním postupem. Nejdříve jsou popsány obecné základy odpovědnosti a jejich aplikace na danou problematiku. Následně je popsána současná právní úprava, včetně úpravy Rady Evropy. Stěžejní část práce je zaměřena na definici nesprávného úředního postupu, převážně ve spojení s nečinností a judikatorními kritérii. …more

This diploma thesis deals with the issues of liability for harm caused by maladministration. First, general groundings of liability and its influence on the topic are described. Further, recent legal regulation including the Council of the Europe legislation is mentioned.
