Indirect effect of the community directives and the Czech case law

Abstract:

Ve své práci se zabývám především doktrínou nepřímého účinku, ale zároveň i historickým vývojem a komunitárními směrnicemi jako takovými. Za cíl své práce si kladu zhodnocení postavení doktríny v současnosti a také se chci věnovat jejím projevům v české judikatuře. Literární prameny, z nichž jsem čerpala, jasně a zřetelně definují možnosti aplikace nepřímého účinku komunitárních směrnic. Požadavek eurokonformního výkladu vnitrostátního práva s právem Evropské unie je zřejmý již v průběhu přístupových jednání. Aby bylo fungování Evropského společenství co nejefektivnější, musí být postup v řízení jednotlivých problémů buď stejný, nebo alespoň obdobný ve všech členských státech. Závěrem bych chtěla znovu zdůraznit jednání v souladu či „ve světle“ norem práva komunitárního, které se v průběhu let stalo jedním z nejvýznamnějších pramenů při rozhodování českých soudů. Je samozřejmostí, že se nejedná jen o otázky s mezinárodním prvkem, ale i o řešení otázek čistě vnitrostátního charakteru. Na principu jednotnosti je Evropská unie založena. Jak jsem již řekla, pro českou judikaturu je nepřímý účinek prozatím jen pramenem při rozhodování českých soudů, reálné využití této aplikace v praxi, aspoň dle informací dostupných ve dnech sepsání práce, chybí.

Abstract:

Theme of my work is the indirect effect of communitary directives and their influence to Czech jurisdiction. My work is wrote out like study about it. I tried to explain what get to contemporary situation, the nature and effect of law of European Union. But it is not the only thing of my interest, I describe also the historical aspects of development of doctrine, what leads to its creation. Every single chapter has small introduction, main text and partial conclusion. Work is wrote out like study which begins at historical events and finished by application of directives, and their indirect effect, to national Czech jurisdiction. Be specific: Chapter 1 talks about the history of law of European Union and about the aspects of development of current position of communitary law in comparision with national legal system of member states. Chapter 2 explains communitary law as it is. Its system of division and relations between singles parts. In this chapter I talk also about secondary law and actas published by bodies of European Union, legal effect of European standards and first specification of directives. Chapter 3 describes application of communitary directives. Decisions of European court of Justice, whose established indirect effect. Explication of concept of indirect effect, terminology, Framework decisions, general competence, timing, individuals in the meaning of habitants of European Union, their position in communitary law, etc. Chapter 4 closes the theme, it means that this chapter is about application of directives to Czech jurisdiction. Chapter 5 is real finish of the whole work. The final chapter presents my opinion concerning the directives, demand for euroconformity, my conclusions regarding to charted area of communitary law. I tried to draw up my work the easiest and the most logical way to comprehension, to bring out useful information and report on the legal effect of communitary law. Examination of historical events, binding treaties and acting of bodies help me to understand why the doctrine of indirect effect came to existence. I answered to diverse questions by searching in cases and proclamation of European court of Justice – there are a lot of references to them in my work. Czech Republic is member of European Union, but not for a long time. For our republic are binding published norms, whose must be effected, and orders of the court are governed by the communitary law, sure, but as least as I know, no one of them doesn´t have indirect effect. That does not mean that situation may change in moment.
