Easements

Abstract:

Tato práce se zabývá právním institutem věcných břemen. Jedná se o věcná práva k věci cizí, která omezují vlastníka služebné věci ve prospěch vlastníka panujícího pozemku či vůči konkrétní osobě. Toto omezení spočívá v pasivní povinnosti něco trpět, něčeho se zdržet či v aktivní formě něco konat či něco dát. Věcná břemena se dělí na služebnosti a reálná břemena. Práce je členěná do několika základních kapitol. První kapitola charakterizuje věcná břemen a začleňuje je do systému v rámci občanského práva, především v rámci práv věcných. Druhá kapitola se věnuje historickému pojetí věcných břemen, kde hlavní část zabírá exkurz do práva římského. Zbytek pojednává o úpravách občanských kodexů, které kdy platily na území České republiky. Třetí kapitola má základ v současné účinné legislativě zákona č. 89/2012 Sb. a vychází z rozdělení věcných břemen na služebnosti a reálná břemena. Větší část je věnována služebnostem-jejich vzniku, zániku, ochraně, nákladech na ně, obsahu atd. Dále práce popisuje konkrétní pozemkové a osobní služebnosti, tak jak je jmenuje zákon. Poslední část je zaměřena na reálná břemena a jejich specifika.

Abstract:

This thesis deals with the legal institute of easements. These are rights in rem to another person's property which restrict the owner of immovable property in favor of another person or another land . Owner is obliged to tolerate something, to refrain from something or to perform something. The easements serve more beneficial usage of someones land or in favor of a particular person. Easements are division into servitudes and real easements. The thesis consists of three main chapters. The first chapter deals with concept and purpose of easements. The second chapter describes the historical development of easements.The main part is devoted to the Roman law concept of easements and the rest deals with the development of the institute in the Czech Republic. The third chapter examines current legislation-Civil Code (Act.No. 89/2012Coll). It is based on the division of easements into servitudes and real easements. The greater part is devoted to servitudes, their division into land and personal, the ways of their origin and termination and the rights arising from them. Furthermore, the thesis deals with particular land and personal servitudes duet he law. Last part is focused on real easesements.
