Social Impact of the Labour Code

Abstract:

Tato diplomová práce se zabývá českým zákoníkem práce a jeho sociálními dopady na život české společnosti. Pomocí analýzy vybraných institutů zákoníku práce poukazuje na pozitivní i negativní aspekty pracovněprávní úpravy. Hlavní pozornost je věnována vzniku a skončení pracovního poměru, výpovědní lhůtě a minimální mzdě. Pro ilustraci je uvedeno i malé srovnání s právní úpravou ve dvou dalších státech Evropské unie. V jedné z kapitol se zabývá úlohou odborů, jak je chápána zákoníkem práce v porovnání s tím, jak ji chápou mnohé odborové organizace.

Abstract:

This final year diploma thesis explores the Czech Labour Code and its social impacts on the life of the Czech society. Through an analysis of selected legal concepts of the Labour Code, it points out both positive and negative aspects of the labour related regulations. The main focus is given to the establishment and termination of employment relationship, notice period and minimum wage. To demonstrate the point, a brief comparison of the legislation for two other countries of the European Union is provided. One of the chapters elaborates on the role of the unions as is construed in the Labour Code while comparing it with how it becomes conceptualized by union organizations.
