Community customs union and relations with third countries - significance of transit customs regimes

Abstract:

Tato diplomová práce je zaměřena na celní problematiku Evropské unie a vztahy se třetími státy, zejména v rámci celního řízení během mezinárodních tranzitních operací. Cílem práce je shrnutí zásadních informací týkající se fungování systému TIR s důrazem na jeho současný vývoj a modernizaci, jelikož systém TIR v současné době prochází velmi dynamickým vývojem, což souvisí jak s jeho komputerizací, tak i změnami v Evropské unii. Snahy Evropské unie týkající se zvýšení bezpečnostních standardů u mezinárodních přeprav zboží vedou k modernizací způsobů výměny dat a komunikačních systémů vzájemným propojováním aktérů zapojených do procesů obchodních transakcí, hlavně tedy celních orgánů států, přepravců, národních záručních sdružení a mezinárodních organizací působicích v celní oblasti. První část práce pojednává o celní unii a společné obchodní politice Evropské unie. Definují se zde samotný pojem celní unie a celní území Společenství, vymezují se vnitřní a vnější aspekty existence celní unie, a krátce se popisuje proces vzniku celní unie Společenství od jejího založení až do současnosti. Další dvě kapitoly se soustřeďují na oblast celní správy a legislativy, a základní dokumentaci tvořící celní legislativu Evropské unie. Čtvrtá kapitola je zaměřena na obchodní politiku Společenství s důrazem na nástroje obchodní politiky a obchodní vztahy vůči třetím státům. Poslední kapitola popisuje současný vývoj a modernizaci celní unie s její novou strategií a modernizovaným celním kodexem Evropské unie. Druhá část je zaměřena na analýzu celního řízení obecně a mezinárodních celních režimů; vysvětluje základní pojmy používané v celním řízení, upřesňuje způsoby výpočtu celní hodnoty a okolnosti, za kterých vzniká celní dluh. Na závěr druhé části jsou uvedeny základní celní režimy fungující (nejen) na území Společenství. Třetí část práce je věnována tranzitnímu celnímu režimu TIR. Na začátku se popisuje vznik a historický vývoj režimu TIR, jeho poslání, zásady a územní působnost. V další kapitole se vymezují základní podmínky pro přijetí a účast v systému. Následující kapitola je vyhrazena vysvětlení principu fungování mezinárodního záručního systému a vzájemných vztahů pohybujících se v něm subjektů a formy ručení držitelů karnetů (dopravců). Poslední podkapitola charakterizuje doklad, na jehož základě jsou mezinárodní přepravy uskutečňovány - karnet TIR. Závěrečná kapitola této části se zaměřuje podrobněji na komputerizaci systému TIR, na inovace a vývoj především v posledních letech. Čtvrtá část zdůrazňuje výhody členství v tranzitních režimech, konkrétně přednosti systému TIR, a oblasti spolupráce Evropské unie a mezinárodního celního režimů TIR. Na závěr se shrnují dúležité poznatky a klíčové momenty práce. Při zpracování diplomové práce byly použity nejaktuálnější zdroje o vývoji celního režimu TIR v souvislosti se spoluprácí s Evropskou unií, jelikož hlavním záměrem této práce je poskytnutí detailních informací o současném stavu a modernizaci celního režimu TIR.

Abstract:

The Diploma thesis is focused on Community customs union and relations with third countries, regarding particularly customs procedure during foreign transit operations. It is aimed to summarize basic knowledge regarding TIR system operation with emphasis on its current development and modernization. At present, TIR regime is experiencing a very dynamic progress, and it is related both to its computerization and changes in the European Union, which tends to enhance safety standards on the international level when shipping the goods. Therefore, the means of communication are improved by the interconnection of main actors engaged in business transactions, such as national customs authorities and associations, traders and international organisations. The first part of the thesis deals with customs union and common trade policy of European Union. It defines the term of customs union and European customs union territory, specifies both internal and external aspects of customs union existence, and shortly describes the process of European customs union creation. The two following chapters are concerned with the customs administration, legislation and basic documentation forming customs legislation of European Union. The fourth chapter describes the development and customs union improvement with its new strategy and modernized customs union codex. The second part concentrates on the analysis of customs procedure in general and international customs regimes. It describes the basic terms used in customs administration, specifies the ways of customs debt calculation and factors which may lead to the customs debt. The closing chapter is devoted to transit regimes functioning not only on the territory of the European Union, but in third countries as well. The third part addresses the TIR transit regime. At the beginning, the foundation and historical development of the regime is described, followed by its mission, principles and territorial scope. In the next chapter the basic conditions of membership are identified. The following chapter is reserved for description and explanation of international guarantee system, mutual relations of its participants and forms of guarantee provision. In the last chapter the carnet TIR - main document used for customs purposes when shipping - is highlighted. The last chapter is focused on TIR system computerization, its innovation and improvement, and development mainly in recent years. The forth part of the thesis emphasizes membership advantages, particularly benefits of TIR system, and outlines the fields of the European Union and TIR system cooperation. The conclusion then summarizes important parts and key elements of the paper. When putting together the thesis, the latest available data on the TIR system progress regarding cooperation with the European Union were used, as the main aim of the thesis was to provide detailed information on the current situation and modernization of TIR regime.
